South Africa - ICJ Petitions Arbitral Tribunal on an investment dispute for leave to intervene as a non-disputing party- Case Foresti et al v South Africa

On 19 August the ICJ filed a petition for leave to intervene before the International Centre for Settlement of Investment Disputes (ICSID) Arbitral Tribunal that deals with the case Foresti et al v Republic of South Africa. The case presents important implications for the right to non-discrimination and the need to repair the damage done by decades of Apartheid policies in South Africa.

Issues of the gender and racial composition of the judiciary, as well as allegations of racism within the judiciary, have come to the fore towards the end of 2004. The introduction of a package of bills allegedly affecting the independence of the judiciary received considerable attention in the first few months of 2005 and is still the subject of ongoing debate. The trial and conviction of Schabir Shaik, the former financial adviser to Jacob Zuma, on charges of corruption and fraud, led to the dismissal of Zuma as deputy president of the country in June 2005. Zuma has subsequently been charged with corruption by the National Prosecuting Authority.

South Africa - ICJ President Chief Justice Arthur Chaskalson and Deputy Chief Justice Langa Honored With Prestigious Human Rights Award

Chief Justice Arthur Chaskalson, President of the International Commission of Jurists (ICJ), and Deputy Chief Justice Pius Langa of the South African Constitutional Court have won the 2004 Peter Gruber International Justice Prize for Advancing Equality and Human Rights, the ICJ announced today.

South Africa - Magistrate Discriminated and Sidelined by Prosecuting Authority

In a letter addressed to the South African Director of Public Prosecutions, the ICJ/CIJL requested that prosecutors review their decision not to initiate any cases at Magistrate Graham Travers' court. The ICJ/CIJL also requested that Mr. Travers' special needs stemming from muscular dystrophy be properly accommodated.

There have been several controversies over judicial appointments as the judiciary is faced with the challenge of developing itself to represent the modern South Africa. Calls were also made during the year to increase judicial accountability. Substantial efforts are being made to correct the injustices of the past, however, serious human rights violations still remain. However, the respect for human rights remains fundamental to South Africa's new constitutional system. The judiciary is independent and has issued several landmark judgements on human rights.

South Africa - Jurists Renew Call for International Peace-Keeping Force

The death of at least 28 individuals yesterday, 28 March 1994, exactly one month prior to the April general elections in South Africa, raises grave concerns about the prospect of free and fair elections in the country. This tragic event happened during an Inkatha Freedom Party (IFP) election-protest march in the centre of Johannesburg.
