The responsible Lesotho authorities have failed to ensure that learners with disabilities are able to enjoy their right to an education. This is because the country has not adequately adopted or implemented its laws and policies guaranteeing inclusive education. As a result many children with disabilities are not attending school at all, or are experiencing schooling which is not inclusive, equal or of adequate quality.

The International Commission of Jurists (ICJ) recently published a new set of legal principles to address the harmful human rights impact of unjustified criminalization of individuals and entire communities. The document, known as The 8 March Principles, was elaborated and endorsed by lawyers from around the world and sets out a human rights-based approach to criminal laws typically penalizing conduct associated with sex, reproduction, drug use, HIV, homelessness and poverty.

The economic, social and cultural rights (ESCR) guaranteed in Nepal’s Constitution are enforceable in Nepal’s courts, which routinely apply international human rights law and standards, including the International Covenant on Economic Social and Cultural Rights (ICESCR). Nevertheless, Nepali lawyers have bemoaned the authorities’ failure – as elsewhere in the world – to execute and implement court orders and judgments.

Today, the International Commission of Jurists, Amnesty International, the Global Initiative for Economic and Social Rights and Human Rights Watch published a joint public statement calling for a strengthening of human rights elements in the World Health Organization (WHO) Intergovernmental Negotiating Body’s Zero Draft of a Pandemic Treaty. The organizations are concerned that without such revisions, the Treaty aimed at addressing a compelling public health and human rights challenge, will not be fit for purpose in the protection human rights.
