(New York) – Nepal’s next government should prioritize amending and passing a transitional justice law that addresses the needs of victims who have waited over 16 years for truth and accountability, Amnesty International, Human Rights Watch, and the International Commission of Jurists (ICJ) said today. The law should meet all domestic and international legal obligations.
The ICJ, together with Lawyers’ Rights Watch Canada (LRWC), delivered an oral statement to the 51st Session of the UN Human Rights Council calling on Cambodia to ensure the independence of the courts and the legal profession.
The ICJ today addressed the state of the judiciary in Ukraine during an interactive dialogue with the Office of the High Commissioner for Human Rights at the UN Human Rights Council.
The ICJ has intervened as a third party before the European Court of Human Rights in a case concerning the involuntary transfers of judges and the consequences of such transfers for the independence of the judiciary. The case of Kurtoğlu Karacık v Türkiye concerns the transfer of several judges to new locations by decision of the High Council of Judges and Prosecutors, against the wishes of the judges concerned and without the possibility of effective judicial review of the decision. In its intervention, the ICJ presents an analysis of international standards related to the transfer of judges, including their right to appeal against involuntary transfers, in light of obligations of under article 6.1 ECHR. It also assesses the current state of judicial independence and the system of transfer of judges in Türkiye within the context of systemic deficiencies in respect of judicial independence in the Turkish judicial system..
The International Commission of Jurists (ICJ) has called on the Azerbaijan authorities to release lawyer Elchin Sadigov and journalist Avaz Zeynally whose arrest on 10 September on charges of bribery is likely to be politically motivated. On 11 September, Binagadi Regional Court of Baku ordered their pre-trial detention for a period of four months. Both have denied the charges against them.
