The court declared unlawful and annulled the order for the immigration detention of a child pending removal. According to Bulgarian law, unaccompanied minors cannot be detained. The court recognized the claimant as one and found that the order did not indicate the circumstances that necessitated the imposition of forcible placement. Furthermore, the detention order lacked reasoning regarding the exceptional circumstances necessitating detention according to directive 2008/115/EC.
