Supreme Court of Poland, decision II KK 148/22, 20 June 2023

The Polish Supreme Court ruled that a refugee who had been wrongfully placed in a refugee camp is entitled to claim compensation from public authorities. The court stated as a general rule that “the deprivation of liberty of a mother with a young child constitutes a threat to the normal development of that child”, in line with to the child’s best interest obligation. Detention shall be treated as a last resort when it comes to international protection proceedings.
