Oral Statement of the International Commission of Jurists (ICJ) On the Universal Periodic Review outcome for Lao PDR

Mr. President,

Concerning the report of the Working Group, Lao PDR supported several important recommendations on combating gender-based violence (GBV) and stated it had taken steps to improve access to services and develop standard operating procedures (SOPs). However, these objectives cannot be realized without measures to counter harmful gender stereotypes, strengthen training for justice professionals, and provide for adequate survivor-protection services. Shelters must be expanded nationwide, providing for adequate lengths of stay and simpler admission criteria. Village Mediation Units as presently constituted must not be used to resolve GBV-related criminal cases. Laws compliant with Lao PDR’s human rights obligations should be adopted to ensure effective investigations and prosecutions and legal reforms should begin immediately with full participation of civil society and survivors.

On development projects, the repeal of Decree No. 84 on Compensation and Resettlement Management in 2023 has undermined Lao PDR’s support for recommendations to respect the rights of persons from affected communities. For years, the Decree provided CSOs and communities with a framework for participation, compensation, and resettlement. Its replacement, the Land Law, is vague and inadequate. This weakening of protections has led to approval of numerous mining projects, without transparent oversight or meaningful community participation.

The ICJ deplores Lao PDR’s refusal to accept recommendations to protect human rights defenders (HRDs) and open civic space. Human rights cannot be realized unless Lao PDR ensures a safe and enabling environment for HRDs and civil society. Yet HRDs, inside the country and in exile, continue to face unlawful killings, enforced disappearances, and harassment through judicial processes, while perpetrators enjoy impunity. Recently adopted Decree No. 536 on Associations grants sweeping powers to authorities, enabling undue restrictions on CSO activities, and must be immediately repealed.

The ICJ urges Lao PDR to accept and fully implement all UPR recommendations without delay.
