Droits de l’Homme et des peuples en Afrique et La charte africaine

Rapport d’une conférence tenue à Nairobi du 2 au 4 décembre 1985, convoquée par la CIJ.

Depuis des années, la Commission internationale de juristes a joué un rôle non négligeable dans la promotion de ce qui est devenue, à présent, la Charte africaine des droits de l’homme et des peuples.

En 1961, elle organisa à Lagos (Nigéria) la première conférence des juristes africains dont le rapporteur spécial était Taslim Olawale Elias, actuellement juge et ancien Président de la Cour internationale de Justice.

La Conférence recommanda, pour la première fois, l’adoption par les gouvernements africains d’une Convention africaine des droits de l’homme.

Cette proposition fut développée plus tard lors d’un colloque de la CIJ tenu à Dakar en 1967 et dont le rapport en anglais et en français fut largement distribué en Afrique, elle fut également soutenue par les conférences organisées au Caire et à Monrovia sous l’égide des Nations Unies et celle d’Addis Abeba organisée par la Commission économique pour l’Afrique.

Cependant, l’étape décisive semble avoir été franchie lors d’un colloque francophone organisé à Dakar, en 1978, par la Commission internationale de juristes et à l’issue duquel les participants ont décidé d’établir un comité de suivi.

Ce comité organisa des missions composées d’éminents juristes africains chargés de présenter les conclusions du colloque en faveur d’une Convention et d’une Commission africaines des droits de l’homme. Ces missions furent reçues par les Chefs d’Etat ou Premiers Ministres de dix pays africains francophones.
