
Report of the UN fact finding mission on the Gaza conflict, ICJ’s call to end impunity

The ICJ provided its views to the Human Rights Committee for the consideration of the 3rd Periodic Report of Switzerland.
In this submission, the ICJ highlights several issues which it considers should be of particular concern to the Committee in its consideration of the Swiss report. In particular, the ICJ is concerned at certain provisions of the Swiss legislation on asylum-seekers and migrants that affect adversely the principle of non-refoulement, their right to a fair expulsion procedure (Article 13 ICCPR) and their right not to be detained arbitrarily (Article 9 ICCPR).

The report summarises the findings of observers appointed by the ICJ for the 2008 and 2009 missions to observe the trial of the journalist J.S. Tissainayagam before the High Court of Colombo.

The ICJ released today its Trial Observation Report on proceedings before the Colombo High Court in the prosecution of J.S. Tissainayagam, a Tamil journalist.
On 31 August 2009, Mr Tissainayagam was convicted under anti-terrorism laws and sentenced by Judge Deepali Wijesundara to 20 years “rigorous imprisonment.”

В этом представлении МКЮ хотела бы обратить внимание Рабочей группы на вопросы независимости судебных органов, ограничений права на справедливое судебное разбирательство, включая право на защиту со стороны выбранного адвоката и неоправданных препятствий для адвокатов при осуществлении их профессиональных функций; а также к недостатком в правовой и практической защите от пыток и других жестоких, бесчеловечных или унижающих достоинства видов обращения.
