ICJ and ECRE third submission on the implementation of M.S.S. judgment

The ICJ and ECRE presented a third joint detailed submission on the new asylum service and appeals system and the situation of detention of asylum seekers in Greece to the Committee of Ministers of the Council of Europe.

The submission was presented on the occasion of a meeting of the Committee of Ministers of the Council of Europe on the implementation by Greece of the European Court of Human Rights’ judgment in the case of M.S.S. v Belgium and Greece. The submission highlighted legal and practical shortcomings in the Greek system with regard to the new asylum service and appeals, on detention of asylum seekers, conditions of detention, access to an effective remedy and non-refoulement.

ICJ submission on Thailand to the UN Committee against Torture

The ICJ has submitted an alternative report in advance of the Committee against Torture examination of Thailand’s initial report under the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment.

The ICJ submission draw’s the Committee’s attention to concerns related to:

  • Security laws in Thailand providing for enlarged executive powers of administrative detention without adequate judicial supervision;
  • The failure by Thai authorities to prosecute perpetrators of torture or ill-treatment; and
  • The failure by authorities to prevent, investigate and prosecute gender-based violence.

The Committee will examine Thailand’s initial report during its 52nd session held in April to May 2014, following which it will adopt Concluding Observations setting out recommendations to the Government.
