Maternal mortality: CEDAW holds Brazil accountable

In a seminal decision in Alyne da Silva Pimentel v. Brazil, CEDAW held that Brazil had violated the Convention on the Elimination of all forms of Discrimination against Women.

Brazil failed to provide requisite care to a woman who died as a result of obstetric complications. The case is the first maternal death case to be decided by an international human rights body.

The case, which was brought by the Center for Reproductive Rights and Citizens’ Advocacy for Human Rights (ADVOCACI), concerned the death of an afro Brazilian woman from pregnancy related complications following inadequate and poor quality medical treatment.

At the request of the applicants the ICJ submitted an Expert Legal Opinion to the Committee.

The ICJ brief concerned the equal rights of women to the enjoyment of the right to the highest attainable standard of health and to an effective remedy.

Concern about the trial against judge Maria Lourdes Afiuni

The ICJ and other Human Rights groups today expressed their concern at the ongoing prosecution of Judge Maria Lourdes Afiuni.  

The organizations called on the Venezuelan authorities to ensure that the trial against the Venezuelan tenured criminal judge comply with all fair trial guarantees provided under international law and Venezuelan Constitution, and hearings be held in public, with access provided to national and international observers.

Pronunciamiento de la CIJ en ocasión de finalizar su visita a Honduras

Entre los días 6 y 10 de diciembre de 2010, la CIJ llevó a cabo una misión de alto nivel a Honduras, con el fin de observar la situación de la independencia judicial.

La delegación de la CIJ mantuvo reuniones con organizaciones de la sociedad civil, defensores de los derechos humanos, dirigentes comunitarios, dirigentes sociales, autoridades de gobierno al más alto nivel, representantes de la Comunidad Internacional, organismos intergubernamentales, representantes del Organismo Legislativo y otros actores relacionados con el derecho de acceso a la justicia y la independencia del Poder Judicial.  La visita se enmarcó dentro de los esfuerzos que la CIJ lleva a cabo en distintos países para acompañar el proceso de democratización de la justicia y el respeto a la independencia judicial.
