The ICJ provided its views to the Human Rights Committee for the consideration of the 3rd Periodic Report of Switzerland.
In this submission, the ICJ highlights several issues which it considers should be of particular concern to the Committee in its consideration of the Swiss report. In particular, the ICJ is concerned at certain provisions of the Swiss legislation on asylum-seekers and migrants that affect adversely the principle of non-refoulement, their right to a fair expulsion procedure (Article 13 ICCPR) and their right not to be detained arbitrarily (Article 9 ICCPR).

In this review, the ICJ addresses the breaches or risks of breaches of Italy’s human rights obligations.
These are resulting from:
- its immigration law, policy and practice; frequent expulsions on grounds of national security;
- widespread attacks on the judiciary and its members;
- the abuse of the state secrets privilege in order to obstruct the prosecution and trial of international crimes, and the failure to define torture as a criminal offence in its domestic legislation.

The ICJ Berlin Declaration on Upholding Human Rights and Rule of Law in Combating Terrorism established eleven principles to ensure counter-terrorism measures remain within the rule of law.
