The ECtHR addressed this case regarding a detention pending expulsion of two convicted applicants captured in Russian territorial waters. The Court held that there has been a violation of Articles 2, 3, 5§1 and 5§4 of the Convention. Regarding Article 5, the ECtHR found that two years of immigration detention without a periodic review and assessment, whether there was a “realistic prospect” of removal despite the passage of time, was exceeded what was reasonably required for the purpose pursued. The Court also highlighted that its recurrent findings of violations of Article 5§1 ECHR in respect of foreigners detained indefinitely in Russia with a view to administrative removal.
