Article 164. Destruction and other infractions with explosives or other lethal devices

Any person delivering, placing, discharging or denotating in, into or against one of the objects defined in the previous article an explosive or another device that has the capability to cause death, serious bodily injury, or substantial material damage through the release, dissemination or impact of toxic chemicals, biological agents or toxins, or radioactive material, shall be punished.

Any person organizing or directing others to commit such infractions, or in any other way contributing to the commission of such infractions by a group of persons acting with a common purpose, if such contribution is intentional and either be made with the aim of furthering the general criminal activity or purpose of the group or be made in the knowledge of the intention of the group to commit the offence or offences concerned, shall be punished.

Any preparation and attempt to commit such offences shall also be punished.

Article 165. Acts involving nuclear material

Any person who commits any of the acts described in articles 70 (Unlawful production, possession and use of warfare weapons or explosives), 71 (Unlawful trade of warfare weapons or explosives) and 72 (Theft, embezzlement, robbery of warfare weapons or explosives), if such acts involve nuclear material, including the threat to use nuclear material to cause death or serious injury to any person or substantial property damage, or to steal nuclear material in order to compel a natural or legal person, international organization or State to do or to refrain from doing any act, shall be punished by []

Any preparation and attempt to commit such offences shall be punished.
