Cambodia: Commission of Inquiry into killing of Kem Ley should be established without further delay

Today, in advance of the second anniversary of the killing of political commentator and human rights defender, Kem Ley, the ICJ reiterates its call for the creation of a independent and impartial Commission of Inquiry to investigate his killing.

The ICJ remains deeply concerned at the apparent lack of progress in investigating the case, as well as the inadequacy of the investigation and prosecution of Oeuth Ang, the only person yet charged or convicted in relation to Kem Ley’s killing.

“The trial of Oeuth Ang left many unanswered questions about the investigation and the killing itself which Cambodia has an duty to resolve as part of the family and public’s right to know the truth,” said Kingsley Abbott, Senior Legal Adviser at the ICJ, who attended the trial.

“The fact that the killing occurred against the backdrop of escalating attacks against human rights defenders and the political opposition and in the context of a history of well-documented apparent extra-judicial killings makes the establishment of an independent and impartial Commission of Inquiry all the more pressing.”

On 7 July 2017, ahead of the one-year anniversary of Kem Ley’s killing, the ICJ and other organizations released a joint letter highlighting crucial concerns about the lack of progress in the investigation of his case, and calling on the Cambodian Government to establish a Commission of Inquiry to carry out an independent, impartial, effective and transparent investigation in line with international law and standards.

These include the International Covenant on Civil and Political Rights and the revised Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016).

Background

At approximately 08:30 on 10 July 2016, Kem Ley, a prominent political commentator and human rights defender, was shot and killed at a petrol station on Monivong Boulevard in Phnom Penh.

Soon afterwards, Cambodian police arrested a suspect approximately two kilometers from the crime scene. The suspect identified himself as “Chuob Samlab”, from Banteay Meanchey province. “Chuob Samlab” means “Meet to Kill” in Khmer.

In a leaked video, “Chuob Samlab” reportedly “confessed” to shooting Kem Ley over a debt the political commentator allegedly owed him – a fact reportedly disputed by Kem Ley’s widow and “Chuob Samlab”’s own wife.

“Chuob Samlab” was later identified as Oeuth Ang from Siam Reap province, according to identity records.

On 23 March 2017, the Phnom Penh Municipal Court found Oeuth Ang guilty of the premeditated murder of Kem Ley on 10 July 2016 and sentenced him to life imprisonment.

The ICJ observed the trial which took place on 1 March 2017, following which it identified eight significant gaps in the investigation which had not been adequately addressed at trial.

Following the verdict, Oeuth Ang’s lawyer told journalists the court had created a new case-file to investigate two men named Pou Lis and Chak who may be relevant to the killing of Kem Ley.

Very little information has been revealed publicly about these possible new case-files.

Oeuth Ang appealed his sentence and, on 4 May 2018, the Court of Appeal reportedly heard the appeal.

There are no reports yet of a judgment being delivered.

Pursuant to international law binding on Cambodia, including the International Covenant on Civil and Political Rights (ICCPR) to which Cambodia is a State Party, Cambodia has a duty to promptly, independently, impartially, and effectively investigate all deaths suspected of being unlawful.

Investigations must seek to identify not only direct perpetrators but also all others who may have been responsible for criminal conduct in connection with the death.

Principle 11 of the UN Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions calls for the establishment of a Commission of Inquiry when ‘the established investigative procedures are inadequate because of lack of expertise or impartiality, because of the importance of the matter or because of the apparent existence of a pattern of abuse, and in cases where there are complaints from the family of the victim about these inadequacies.’

Key qualities for the next UN High Commissioner for Human Rights (UN statement)

The ICJ and other NGOs today highlighted the need for the next UN High Commissioner for Human Rights to continue to maintain a strong voice and independent voice for human rights.

The statement was delivered by International Service for Human Rights (ISHR), on behalf of a number of NGOs, during a general debate at the UN Human Rights Council in Geneva. It read as follows:

“Thank you Mr. President,

We want to highlight key features for the next High Commissioner – the world’s premier human rights defender – whose mandate includes providing technical assistance and capacity building to States, as well as standing up for universal human rights and those who defend them.

The work of the next High Commissioner, and of human rights defenders more broadly, is essential to justice, fairness and dignity for all. Defenders contribute to sustainable and inclusive development. They combat corruption and the misuse of power. They promote good government, transparency and accountability. They seek to ensure that no-one gets left behind.

Despite this, around the world, defenders face mounting attacks and criminalisation for standing up to power, privilege, prejudice and profit. Their work has never been more important, nor more imperiled.

Mr President, it is in this context we say that the next UN High Commissioner needs to be a dedicated human rights defender. They need to be committed to working with and for human rights defenders; consulting and partnering with them, supporting their causes, and speaking out and protecting them when they are threatened or attacked.

The next High Commissioner needs to build strategic alliances with States, civil society, academics and business enterprises with a shared interest in human rights and the rule of law. They need to be fiercely independent, but also collaborative and capable of building influential partnerships and coalitions.

With the promotion, protection and realisation of human rights being linked to the attainment of peace, security and sustainable development, the next High Commissioner needs to be strongly supported by the UN Secretary-General and key UN agencies. Mr President, while the High Commissioner may be the UN’s premier human rights defender, it is time for the entire organisation to put human rights defenders up front.”

Conclusions of the Conference on Judicial Independence, Guatemala City, 18-19 June 2018

The ICJ is deeply concerned about the increase in the abuse of disciplinary measures against independent and impartial judges and about crimes committed against human rights defenders. These attacks are putting the rule of law at risk in Guatemala.

The ICJ therefore urges the Inter-American Commission on Human Rights, the Subcommittee on Human Rights of the European Parliament and the UN Special Rapporteur on the Independence of Judges and Lawyers to carry out visits to the country so as to verify the situation.

Judges facing malicious disciplinary proceedings

From 18-19 June 2018, the ICJ hosted a conference on the independence of judges with participants from different Central American judges’ associations.

The conference was able to verify that impartial and honourable judges face on-going disciplinary actions that seek to have then recused from trials or have them removed from office on account of their judicial decisions.

Judges are facing the malicious use of the judicial disciplinary system by groups or persons who disapprove of judicial rulings in high-impact cases.

The meeting was an opportunity for different justice sector institutions and judges, victims of attacks, to analyse fundamental concepts and international standards on the judiciary.

The conference concluded, the judicial career system must guarantee that a higher judicial authority can only sanction judges for legally established reasons as set down by international standards.

There was a full agenda of discussions with the participation of the Association of Guatemala Judges for Integrity (AGJI), the President of the Supreme Electoral Tribunal, the Supervisor General of Courts, judges from the Penal Chamber of the Supreme Court, the Commissioner of the International Commission against Impunity in Guatemala (CICIG) and the plenary of the Council of the Judicial Career.

The conference examined attacks against judges and their impact, case by case, in the light of international standards. The conference concluded that judges including Ericka Aifán, Yassmín Barrios, Miguel Ángel Gálvez, Carlos Ruano and Pablo Xitumul are facing disciplinary measures because they have acted independently and impartially.

The spurious complaints presented against them before the judicial disciplinary system or other State institutions should be excluded “in limine”.
