In the case of Mohammed Momin Khawaja, the first individual charged under Canada’s Anti- terrorism Act, the Ontario Superior Court decided not to disclose all secret evidence to the defence lawyers but to provide them with a summary of the evidence. The Government has appealed that decision before the Federal Court of Appeal on national security grounds.
