The Tunisian authorities must drop all charges against anyone being prosecuted under Decree 54 for the legitimate exercise of their freedom of expression, and provide reparation for the harm suffered to the victims of such arbitrary prosecutions, the International Commission of Jurists (ICJ) said today.

In a new briefing paper published today, the ICJ examines the Tunisian authorities’ enforcement of Decree 54 through which they have imposed illegal and arbitrary restrictions on the legitimate exercise of the right to freedom of expression, among other human rights.

The International Commission of Jurists (ICJ) applauds the European Court οf Human Rights judgement of 6 July 2023 in the case of Tuleya v Poland which effectively affirms the need for Poland to change course in its approach on the independence of the judiciary in the country.
The ICJ calls on the responsible Polish authorities to promptly implement the judgement and reverse the measures taken in recent years with a view to strengthening the rule of law in the country.

As the United Nations Human Rights Council concludes its 53rd session in Geneva, the ICJ welcomes the Council’s continued commitment to addressing some of the critical challenges of the day, including violence against women and girls, the rights of migrants, the independence of the judiciary, and the impact of new technologies and climate change on human rights. At the same time, some States at the Council have persisted in calling into question and undermining hard-fought gains in such areas as the protection of the rights of LGBTI persons, or sexual and reproductive health and rights.

The International Commission of Jurists (ICJ) has renewed its call for the immediate release of Buzurgmehr Yorov, an imprisoned Tajikistan lawyer, and expressed deep concern over his recent additional sentencing. This follows the decision by Vahdat city court on 10 July 2023 to add an extra ten years to Yorov’s existing sentence, accusing him of large-scale fraud.

In response to a Call for Inputs to inform an upcoming thematic report by the United Nations (UN) Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression (the Special Rapporteur), the International Commission of Jurists (ICJ) provided a substantive submission providing concrete examples of gendered disinformation and of the responses by States, companies and organizations, as well as potential solutions to combat this phenomenon. The Special Rapporteur’s report is to be presented at the UN General Assembly’s 78th Session in October 2023.
