Международная комиссия юристов (МКЮ) завершила миссию по установлению фактов, касающихся уголовного преследования и суда над правозащитником Азимжаном Аскаровым.
Миссия была предпринята в ответ на заявления о нарушениях прав человека в данном деле, в том числе, нарушениях международных норм справедливого судебного разбирательства во время следствия и суда. Особая обеспокоенность выражалась по поводу применения пыток и жестокого обращения в отношении г-на Аскарова, запугивания адвокатов и оказания политического давления на судей.
Азимжан Аскаров, известный правозащитник, был осужден за ряд тяжких преступлений, включая соучастие в убийстве и возбуждение национальной ненависти, после вспыхнувшего насилия на этнической почве в Кыргызстане в июне 2010 года.
Он был приговорен к пожизненному заключению БазарКурганским районным судом. 20 декабря эксперты Миссии присутствовали на слушании в Верховном Суде в Бишкеке, где рассматривалось обжалование осуждения Азимжана Аскарова в надзорном порядке.
Суд подтвердил виновность и пожизненное заключение Аскарова.
МКЮ была приглашена Советом правозащитников Кыргызстана для проведения наблюдения за слушанием в Верховном суде и оценке того, в какой степени в деле против г-на Аскарова были соблюдены международное право прав человека и национальные процедуры.
Миссия, проходившая с 19 по 21 декабря, провела ряд встреч с правозащитными НПО, Азимжаном Аскаровым, его адвокатами, представителями потерпевших, генеральным прокурором, изучила материалы дела.
Миссия состояла из трех международных экспертов-юристов:
Роушин Пиллей, старшего правового советника Программы МКЮ по Европе;
к.ю.н. Данияра Канафина, адвоката;
к.ю.н. Евы Ритер, Университет Неймегена.
Основные выводы и рекомендации МКЮ по данному делу будут опубликованы в ближайшее время в отчете, где будут представлены фактические обстоятельства дела и дана юридическая оценка уголовного преследования, содержания под стражей и приговора Азимжану Аскарову.

The ICJ has concluded a fact finding mission concerning the prosecution and trial against human rights defender Azimjan Askarov. The mission was undertaken to respond to allegations of human rights violations surrounding the case, including breaches international fair trial standards during the investigation and trial. Particular concerns were raised about torture and ill-treatment of Mr Askarov, intimidation of lawyers and political pressure on judges.

The ICJ and other human rights groups provide their views on the priorities and objectives of the UK Government as it takes its role of Chairmanship of the Committee of Ministers of the Council of Europe.
In particular, the joint statement expresses the signing NGOs’ views on the UK Chairmanship’s proposals on the reform of the European Court of Human Rights.

It was with great sadness that the ICJ learned today of the passing of Professor Antonio Cassese who died this weekend at the age of 74 following a long fight with illness.
Professor Cassese was an Honorary Member of the ICJ having previously served as an ICJ Commissioner between 1995 and 2005. He was a distinguished figure in international justice, serving in a number of significant legal roles, and held the position of Professor of International Law at the University of Florence from 1975 until 2008.
Our thoughts and condolences are with his family.

In this submission, the ICJ highlights several issues which it considers should be of particular concern to the Committee in its consideration of the periodic reports of Greece.
During its 47th session on 31 October to 25 November 2011, the UN Committee against Torture will undertake an examination of the combined fifth and sixth periodic reports of Greece. The ICJ has submitted a parallel report to the Committee against Torture, which focusses on the failure of the Greek asylum system, in practice, to comply with the obligations of non-refoulement (as this applies to article 3 of the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment); and at the prevalence of conditions of detention for migrants, as well as living conditions for migrants, that amount to cruel, inhuman or degrading treatment in violation of obligations to prevent such treatment under articles 2, 11 and 16 of the Convention.
