Myanmar: amendments restrict legal aid for thousands of detainees

The Myanmar military government must urgently reverse recent amendments to the Legal Aid Act that place impermissible restrictions on legal defense for detainees, particularly for those detained on criminal charges, and already vulnerable people such as stateless people, asylum seekers, and migrants, said the ICJ today.

The ICJ stressed that military regime was unlawfully assuming legislative powers it did not possess, in defiance of the core principle of separation of powers.

“The Myanmar military has usurped power illegally and now it is improperly changing the laws to make it even more difficult to get legal aid necessary to defend the rights of thousands of people facing arbitrary arrest and detention,” said Sam Zarifi, ICJ’s Secretary General.

In May 2021, the military regime made key amendments to the 2016 Legal Aid Law, formally entitled The Pyidaungsu Hluttaw Law No. 10, 2016, The 9th Waning Day of Pyartho, 1377, M.E.

The new amendment removes legal aid services at least during pre-trial detention, a critical phase when detainees are particularly at risk of arbitrary detention, torture and ill-treatment and other forms of coercion and tampering with evidence.

The amendments to Section 2(b) prevent all persons from certain vulnerable groups from receiving legal aid, including but not limited to stateless persons, asylum seekers, foreigners, migrant workers.

“These amendments will prevent legal aid for precisely the people who need it most, those facing criminal charges and those from marginalized groups, at precisely the time they need it most, during the pretrial detention when their rights are most at risk,” Zarifi said.

All reference to international standards have been removed as per Section 3(b), thus leaving the terms unbound by normative requirements and restrictions and more vulnerable to be subjected to arbitrary decisions of the Government. The revocation of 3(e) means that the fair standards and procedures concerning how long victims can be arrested and kept in custody do not have to be adhered to.

“In the context of Myanmar, where those pro-bono lawyers and organizations representing detainees continue to face threats, intimidation, abduction and arrest warrants, the possibility of getting legal defense through the legal aid system is critically important to provide access to justice to those thousands of detainees to ensure their right to equality before the law, the right to legal counsel and the right to a fair trial,” Zarifi said.

The United Nations Principles and Guidelines on Access to Legal Aid in Criminal Justice System requires all States to guarantee the right to legal aid in their national legal systems, without discrimination on any grounds.

The latest amendments have removed all independence of the legal aid bodies, and instead given full control to the Supreme Court, supported by the Cabinet—both bodies dominated by the military.

“With a number of lawyers being arbitrarily detained in recent days, these new amendments are another threat tactic by the military, to ensure that those are arrested and detained do not get a fair trial,” Zarifi added.

Israel: ICC must investigate forced displacement of Palestinians in Sheikh Jarrah and attacks against civilians in Gaza

The International Criminal Court (ICC) must immediately investigate the forced eviction of Palestinian families and residents in Sheikh Jarrah and other neighbourhoods in East Jerusalem, as well as any indiscriminate and disproportionate attacks against civilians in the Gaza Strip, the ICJ said today.

The investigation must establish whether any serious violation of international humanitarian law, such as indiscriminate or disproportionate attacks against civilians, the forced deportation of Palestinians and the transfer of Israeli settlers into occupied East Jerusalem, as well as the extensive destruction and appropriation of property, have taken place in Sheikh Jarrah and in Gaza. Following the opening of an investigation by the ICC Office of the Prosecutor, if warranted, Israeli officials should be prosecuted for such crimes to ensure accountability. As confirmed by the ICC Pre-Trial Chamber I, the Court’s territorial jurisdiction “extends  to  the  territories  occupied  by Israel since 1967, namely Gaza and the West Bank, including East Jerusalem.”

Evictions against Palestinians in Sheikh Jarrah were ordered by the Jerusalem District Court following legal proceedings initiated by Israeli settlers organizations under Israeli law. The Supreme Court was due to rule on 10 May 2021 on challenges against evictions brought by Palestinian families, yet, it decided to postpone the hearing at the request of Israel’s Attorney-General.

“Evictions in Sheikh Jarrah are part of a cynical campaign by the Israeli authorities to purge occupied East Jerusalem from its Palestinian civilian population,” said Said Benarbia, the ICJ MENA Director.

The ICC must also ensure accountability for unlawful attacks targeting civilians and civilian objects in connection to the hostilities between Israel and Palestinian armed groups in Gaza. Since 2007, Israel has imposed a full closure on Gaza, which has resulted in a major humanitarian crisis, and has led to significant escalation of hostilities in 2008-09, 2012 and 2014, where thousands of Palestinians have been killed and injured. On 10 May 2021, Hamas started firing rockets against Israel following a crackdown on Palestinian worshippers in the al Aqsa compound in Jerusalem. In response, Israel has carried out multiple airstrikes in Gaza, which have reportedly caused the death of at least 24 people, including nine children. All parties to the conflict are prohibited from conducting indiscriminate and disproportionate attacks, which may amount to war crimes under the Rome Statute.

“The ICC must ensure that all those responsible for ordering and carrying out these attacks be held criminally accountable,” Benarbia added.

Since April 2021, Palestinians peacefully demonstrating against the evictions in Sheikh Jarrah, a decades-long legal battle, have been subjected to violence by Israeli settlers and Israeli security forces. Earlier this year, the Jerusalem District Court ordered that several Palestinian families be evicted from the neighborhood. According the UN Office of the High Commissioner for Human Rights, “at least 218 Palestinian households in East Jerusalem, including the families in Sheikh Jarrah, have eviction cases filed against them”, and overall “970 people, including 424 children, [are] at risk of displacement.”

As part of the Israeli crackdown on Palestinians, Israeli security forces have also been firing tear gas and employing other less-lethal weapons against people praying at the Al Aqsa mosque in Jerusalem purportedly in crowd-control operations. According to the Palestinian Red Crescent, more than 200 demonstrators have been injured as a result of the use of such less-lethal weapons.

Israeli forces have also been preventing gatherings of Palestinians at Damascus Gate in East Jerusalem during the night hours of the month of Ramadan when many Muslims gather for prayer and breaking of the fast at sunset, and have responded with excessive force to the ensuing demonstrations.

Israel has a duty to respect the right to peaceful assembly and freedom of religion of Palestinians in East Jerusalem. Israel’s use of excessive force against Palestinian demonstrators and the crackdown on Palestinian worshippers violate its obligations under international human rights law

“Israeli authorities must respect and ensure the right of Palestinians to protest and challenge decades of prolonged unlawful occupation and related abusive practices, and immediately end the use of disproportionate and unlawful force to disperse protesters”, Benarbia said.

Lebanon: the military has no role in policing public protests, let alone in arresting, detaining and prosecuting ordinary civilians

The ICJ and the Lebanese Center for Human Rights (CLDH) are deeply concerned about the role of the military in the arrest, detention and referral for prosecution by military courts of dozens of civilians in Tripoli.

The military’s crackdown has taken place in the context of ongoing protests in the city against a dire economic situation exacerbated by the nation-wide lockdown imposed by the government with the stated intention of combatting the COVID-19 pandemic.

“Under the Rule of Law, the military has no business policing demonstrations, detaining protesters or prosecuting civilians,” said Said Benarbia, the ICJ’s Middle East and North Africa Programme Director. “Instead of addressing the legitimate grievances of those protesting, the Lebanese government is using the military to silence dissenting voices by arresting and sending protestors for trial before military tribunals.”

While the military reported the arrest of five individuals on 27 January, five on 29 January and another 17 on 31 January, for, among other things, allegedly engaging in “rioting,” “vandalism” and “obstruction of civil defence,” other sources suggest at least 58 civilians were arrested by the military in connection with the above-mentioned protests in Tripoli. The whereabouts of many detainees remained undisclosed for days following their arrest. According to lawyers, the military’s Office of Public Prosecution has referred at least 14 individuals to a military Investigating Judge.

The ICJ and CLDH call on the Lebanese authorities to ensure that the military plays no role in policing the ongoing protests and in other law enforcement functions that are properly the sole responsibility of civilian law enforcement agencies. The military courts’ jurisdiction, in particular, must be confined exclusively to the commission of military offences by military personnel and, in turn, totally exclude the possibility of prosecuting civilians, as well as cases involving the perpetration of human rights violations by military personnel.

Referrals by the military’s Office of Public Prosecution follow an increasing, worrying trend of trying those involved in anti-government protests before military courts, which are neither independent nor impartial, and whose procedures do not comply with international fair trial standards.

“Lebanon’s military tribunals have a grim history of unfair trials and politicized proceedings against those suspected of opposing the government,” said Fadel Fakih, CLDH’s Executive Director. “If faith in the Lebanese justice system is to be restored, the jurisdiction of military tribunals must be fully reformed,” he added.

In a 2018 briefing paper entitled “The Jurisdiction and Independence of the Military Courts System in Lebanon in Light of International Standards,” the ICJ called on the Lebanese authorities to enhance the independence and impartiality of military courts, ensure the fairness of their procedures, and restrict their jurisdiction to cases involving members of the military for military offences.

Egypt: authorities must release Egyptian Initiative for Personal Rights staffers and cease persecution of civil society

The ICJ today called on the Egyptian authorities to immediately and unconditionally release human rights defenders Gasser Abdel-Razek, Mohamed Bashseer and Karim Ennarah.

The detainees, senior staffers of the Egyptian Initiative for Personal Rights (EIPR), a leading human rights organization, were targeted in connection with their human rights work.

The arrests are part of a broader, relentless campaign by the military and government to intimidate and silence civil society organizations, including through such means as trumped-up “terrorism” charges and sham judicial proceedings.

“By arresting Mohamed Bashseer, Karim Ennarah and Gasser Abdel-Razek, and charging them with terrorism-related offences, the Egyptian government led by President Al-Sisi are writing a new, terrifying chapter in their repression playbook,” said Said Benarbia, Director of ICJ’s Middle East and North Africa Programme.

“Their crackdown on independent civil society must end.”

On 19 November 2020, Gasser Abdel-Razek, EIPR’s Executive Director, was arrested by security forces from his home in Maadi, Cairo. He appeared before the Supreme State Security Prosecution (SSSP) and charged in case No. 855/2020 with, among other charges, “joining a terrorist group” and “spreading false news.”

On 15 November 2020, EIPR’s Administrative Manager Mohamed Bashseer, was arrested at his house in Cairo. On 17 November 2020, Karim Ennarah, EIPR’s director of the criminal justice programme, was also arrested.

They both face similar charges in the same case No. 855/2020, together with other numerous lawyers and human rights defenders, including Mohamed El-Baqer and Mahienour al-Massry.

Over the past seven years, EIPR has been subjected to a pattern of harassment and persecution by the military and government.

In 2016,  the assets of EIPR’s founder and former executive director, Hossam Bahgat, were frozen and he was subjected to a travel ban since then.

On February 2020, Patrick George Zaki, an EIPR researcher, was arrested at Cairo Airport by National Security Agency officers who reportedly subjected him to torture, including with electric shocks. He was charged by a public prosecutor with, among other charges, “spreading false news” and “inciting protest without authorization”. He remains in custody

The recent arrests of the three senior EIPR officials follow a visit by a number of European ambassadors and other diplomats to the EIPR Cairo offices on 3 November 2020, during which the human rights situation in Egypt was discussed.

“The international community and in particular States engaging in political and security cooperation with Al-Sisi’s regime must not overlook the serious violations against human rights defenders taking place in the country,” added Benarbia.

“They should demand an end to these violations and ensure that individuals and independent human rights groups are able to do their legitimate and critical human rights work freely and without intimidation.”

At UN, ICJ highlights Egypt’s attacks on the independence of lawyers

Today at the UN Human Rights Council, the ICJ together with the Tahrir Institute for Middle East Policy, drew attention to ongoing attacks on the independence and role of lawyers in Egypt.

The ICJ made the oral statement during the general debate on country situations of concern, speaking on behalf also of the Tahrir Institute for Middle East Policy. The statement read as follows:

“The International Commission of Jurists (ICJ) and the Tahrir Institute for Middle East Policy draw the Council’s attention to the continuing deterioration of the situation for human rights and the rule of law in Egypt.

Today our organizations published a new report, Targeting the Last Line of Defense: Egypt’s Attacks against Lawyers, to be followed by a virtual side event on 30 September.

As the last line of defense against the government’s sustained and broad crackdown on human rights and fundamental freedoms, Egypt’s lawyers have been increasingly and systematically targeted by authorities. Since 2018, at least 35 lawyers have been arrested and arbitrarily detained for their legal defense work and exercise of fundamental freedoms.

Lawyers have been subject to arbitrary arrest and detention, physical assault, torture and other ill-treatment, and enforced disappearances, as well as unfounded and politicized criminal proceedings based on charges under grossly overbroad criminal laws on “terrorism,” “spreading false news,” and “misusing social media.” Arrests of lawyers spiked in the wake of the September 2019 protests. Arrests continue despite the risk of a COVID-19 outbreak in detention facilities.

The ICJ and Tahrir Institute call on Egyptian authorities to end these violations of the rights and role of lawyers, to take measures to protect the independence of the Bar Association, and to amend all relevant legal frameworks in line with Egypt’s constitution and international human rights law and standards.
