Israel: ICC must investigate forced displacement of Palestinians in Sheikh Jarrah and attacks against civilians in Gaza

The International Criminal Court (ICC) must immediately investigate the forced eviction of Palestinian families and residents in Sheikh Jarrah and other neighbourhoods in East Jerusalem, as well as any indiscriminate and disproportionate attacks against civilians in the Gaza Strip, the ICJ said today.

The investigation must establish whether any serious violation of international humanitarian law, such as indiscriminate or disproportionate attacks against civilians, the forced deportation of Palestinians and the transfer of Israeli settlers into occupied East Jerusalem, as well as the extensive destruction and appropriation of property, have taken place in Sheikh Jarrah and in Gaza. Following the opening of an investigation by the ICC Office of the Prosecutor, if warranted, Israeli officials should be prosecuted for such crimes to ensure accountability. As confirmed by the ICC Pre-Trial Chamber I, the Court’s territorial jurisdiction “extends  to  the  territories  occupied  by Israel since 1967, namely Gaza and the West Bank, including East Jerusalem.”

Evictions against Palestinians in Sheikh Jarrah were ordered by the Jerusalem District Court following legal proceedings initiated by Israeli settlers organizations under Israeli law. The Supreme Court was due to rule on 10 May 2021 on challenges against evictions brought by Palestinian families, yet, it decided to postpone the hearing at the request of Israel’s Attorney-General.

“Evictions in Sheikh Jarrah are part of a cynical campaign by the Israeli authorities to purge occupied East Jerusalem from its Palestinian civilian population,” said Said Benarbia, the ICJ MENA Director.

The ICC must also ensure accountability for unlawful attacks targeting civilians and civilian objects in connection to the hostilities between Israel and Palestinian armed groups in Gaza. Since 2007, Israel has imposed a full closure on Gaza, which has resulted in a major humanitarian crisis, and has led to significant escalation of hostilities in 2008-09, 2012 and 2014, where thousands of Palestinians have been killed and injured. On 10 May 2021, Hamas started firing rockets against Israel following a crackdown on Palestinian worshippers in the al Aqsa compound in Jerusalem. In response, Israel has carried out multiple airstrikes in Gaza, which have reportedly caused the death of at least 24 people, including nine children. All parties to the conflict are prohibited from conducting indiscriminate and disproportionate attacks, which may amount to war crimes under the Rome Statute.

“The ICC must ensure that all those responsible for ordering and carrying out these attacks be held criminally accountable,” Benarbia added.

Since April 2021, Palestinians peacefully demonstrating against the evictions in Sheikh Jarrah, a decades-long legal battle, have been subjected to violence by Israeli settlers and Israeli security forces. Earlier this year, the Jerusalem District Court ordered that several Palestinian families be evicted from the neighborhood. According the UN Office of the High Commissioner for Human Rights, “at least 218 Palestinian households in East Jerusalem, including the families in Sheikh Jarrah, have eviction cases filed against them”, and overall “970 people, including 424 children, [are] at risk of displacement.”

As part of the Israeli crackdown on Palestinians, Israeli security forces have also been firing tear gas and employing other less-lethal weapons against people praying at the Al Aqsa mosque in Jerusalem purportedly in crowd-control operations. According to the Palestinian Red Crescent, more than 200 demonstrators have been injured as a result of the use of such less-lethal weapons.

Israeli forces have also been preventing gatherings of Palestinians at Damascus Gate in East Jerusalem during the night hours of the month of Ramadan when many Muslims gather for prayer and breaking of the fast at sunset, and have responded with excessive force to the ensuing demonstrations.

Israel has a duty to respect the right to peaceful assembly and freedom of religion of Palestinians in East Jerusalem. Israel’s use of excessive force against Palestinian demonstrators and the crackdown on Palestinian worshippers violate its obligations under international human rights law

“Israeli authorities must respect and ensure the right of Palestinians to protest and challenge decades of prolonged unlawful occupation and related abusive practices, and immediately end the use of disproportionate and unlawful force to disperse protesters”, Benarbia said.

Sri Lanka: New anti-terror regulations aimed at organizations further undermine the rule of law

The ICJ today condemned the promulgation by President Gotabaya Rajapaksa of new vague and overbroad anti-terrorism regulations, which make the already deeply flawed Prevention of Terrorism Act (PTA) open to further abuse.

The Prevention of Terrorism (Proscription of Extremist Organisations) Regulations No. 2 of 2021, published by way of Gazette notification on the 13 April 2021, outlaw 11 organisations identified as ‘extremist’ and provides criminal penalties for those accused of various kinds of associations with these and other organizations that may be similarly disfavoured.

A person who acts in contravention of the regulations is liable to a term of imprisonment up to twenty years, while any person who “conspires to commit or attempts, abets or engages in conduct in preparation to commit an offence” may be sentenced to a term of imprisonment of up to ten years.

“These ill-defined offences follow a similar pattern of the Sri Lankan executive unilaterally promulgating abusive regulations in the name of fighting terrorism over the years” said Ian Seiderman. “These latest ones come just a month after the decreeing of the ‘de-radicalisation’ regulations which allow for the Government to arbitrary detain people for up to two years without trial.”

Moreover, the listed acts shall amount to an offence not only in relation to the eleven

identified organizations, but also to any other organisation “representing or acting on behalf of such organisation or is connected with or concerned in such organisation or which is reasonably suspected of being connected with or concerned in any of the activities”. This is in violation of the principle of legality as the State may ex post facto identify any organisation as having associated with the eleven banned organisations.

The ICJ said that the Regulations were in contravention of the guarantees under article 13 of the Sri Lankan Constitution and its international legal obligations under the International Covenant on Civil and Political Rights.

A key precondition to a fair trial recognized internationally is that criminal offences must be prescribed by law and conform to the principle of legality. Vague laws undermine the rule of law because they leave the door open to selective and arbitrary interpretation and prosecution. The vague wording of a law also has an adverse impact on framing of the charge against the accused.

Following the promulgation of the ‘de-radicalisation’ regulations a number of persons belonging to minority communities were reportedly arrested under the PTA, including for ‘spreading Wahhabism via social media’ and ‘promoting terrorism related activities’.

“While the Sri Lankan Government has an obligation to protect its inhabitants from the threat of terrorism, that protection is a part of, and must not be seen in conflict with, its overall duty to protect human rights; ‘threats to national security’ can never be used as a justification for contravening basic standards in relation to freedom from arbitrary arrest”, said Ian Seiderman.

The ICJ has consistently called for the repeal of the Prevention of Terrorism Act, which has been used to arbitrarily detain suspects for months and often years without charge or trial, facilitating torture and other abuse. The ICJ reiterates its call for the repeal and replacement of this vague and overbroad anti-terror law and all regulations brought under it, in line with Sri Lanka’s international obligations.

The UN High Commissioner for Human Rights in her most recent report on Sri Lanka has reiterated the call for a moratorium on the use of the Prevention of Terrorism Act for new arrests until it is replaced by legislation that adheres to international best practices.

Sri Lanka: ‘De-radicalization’ regulations should be immediately withdrawn

The ICJ today condemned Sri Lanka’s new ‘de-radicalization’ regulations, which allow for the arbitrary administrative detention of people for up to two years without trial. The regulations could disproportionately target minority religious and ethnic communities.

Sri Lankan President Gotabaya Rajapaksa promulgated Prevention of Terrorism (De-radicalization from holding violent extremist religious ideology) Regulations No. 01 of 2021, which was publicized by way of gazette notification on 12 March, 2021. The “regulations”, which were dictated by the executive without the engagement of Parliament, would send individuals suspected of using words or signs to cause acts of “religious, racial or communal violence, disharmony or feelings of ill will” between communities to be “rehabilitated” at “reintegration centres” for up to two years without trial.

“These regulations, which have been dictated by executive fiat, allow for effective imprisonment of people without trial and so are in blatant violation of Sri Lanka’s international legal obligations and Sri Lanka’s own constitutional guarantees under Article 13 of the Sri Lankan Constitution.”

Article 9 of the International Covenant on Civil and Political Rights (ICCPR), to which Sri Lanka is a party, provides for a number of procedural guarantees for any person deprived of their liberty, many of which are absent in the Regulation. Administrative detention of the kind contemplated under the Regulations, is not permitted, as affirmed repeatedly by the UN Human Rights Committee.

Even prior to the promulgation of the new regulations under Sri Lanka’s Prevention of Terrorism Act No. 48 of 1979 (PTA), Sri Lankan authorities had already been invoking the PTA and the International Covenant on Civil and Political Rights Act, No. 56 of 2007 (enacted to incorporate certain provisions of the ICCPR into domestic law) effectively to persecute people from minority communities. Yet little or no action has been taken by the authorities against those inciting hatred or violence against minorities.

“The new regulations are likely to be used as a bargaining tool where the option is given to a detainee to choose between a year or two spent in “rehabilitation” or detention and trial for an indeterminate period of time, instead of a fair trial on legitimate charges.”

Background

Section 3(1) of the ICCPR Act which prohibits advocacy of hatred that constitutes incitement to discrimination, violence or hostility has hitherto been misused to target members of minority communities. In April 2020, Ramzy Razeek, a retired government employee, was arrested for a Facebook post calling for an ideological ‘jihad’ against the policy of mandatory cremation of people who had died as a result of Covid-19. He was detained under the ICCPR Act for more than five months and finally released on bail due to medical reasons in September 2020.

In May 2020, Ahnaf Jazeem, a young Muslim poet, was arrested under the PTA in connection with a collection of poems he had published in the Tamil language, which were apparently misinterpreted by Sinhalese authorities to be read as containing extreme messages. Just last week, a few days after the promulgation of the new regulations, Ahnaf’s lawyers expressed alarm that both Ahnaf and his father were being pressured to make admissions that he had engaged in teaching ‘extremism’. The ICJ had previously raised concerns about the arbitrary arrest and prolonged detention of Human Rights lawyer Hejaaz Hizbullah. After being detained under the PTA for 10 months without being given reason for his arrest, he is now being tried for speech-related offences under the PTA and ICCPR Act.

The ICJ has consistently called for the repeal of the Prevention of Terrorism Act, which has been used to arbitrarily detain suspects for months and often years without charge or trial, facilitating torture and other abuse. The ICJ reiterates its call for the repeal and replacement of this vague and overbroad anti-terror law and regulations brought under it, in line with Sri Lanka’s international obligations.

The new PTA regulations require those who surrender or are arrested on suspicion of using words or signs to cause acts of violence, disharmony or ill will between communities to be handed over to the nearest Police Station within 24 hours after which a report is to be submitted by the Police to the Defence Minister (the position is currently held by President Gotabaya Rajapaksa) to consider whether the suspect should be detained further. The regulations would also apply to those who had surrendered or been taken into custody under the PTA, the Prevention of Terrorism (Proscription of Extremist Organizations) Regulations No. 1 of 2019 and the Emergency (Miscellaneous Provisions and Powers) Regulation, No. 1 of 2019.

The Attorney General is given the power to decide if a suspect should be tried for a specific offence or be send to a rehabilitation centre as an alternative. If the decision is to rehabilitate, the suspect would be produced before a Magistrate with the written consent of the Attorney General. The Magistrate may thereafter order that the suspect be referred to a rehabilitation centre for a period not exceeding one year. Such period can be extended by a period of six months at a time up to one more year by the Minister upon the recommendation of the Commissioner-General for Rehabilitation. The regulations further state that the Commissioner–General should provide the detainee with psycho-social assistance and vocational and other training during the rehabilitation period to ensure reintegration into society. The regulations also provide that such detainee may with the permission of the officer in charge of the Centre be entitled to meet their parents, relations or guardian once every two weeks.

Today, during a General Debate, the ICJ called on the UN Human Rights Council to condemns a set of laws amendend by the military governmentn in Myanmar and restricting human rights, and to demand the return to of Myanmar civilian rule respecting the rule of law.

 

The statement reads as follows:

“Madame President,

The International Commission of Jurists (ICJ) condemns the illegitimate attempts to “amend” several laws by the Military appointed Myanmar’s State Administration Council (SAC) following its unlawful seizure of power on 1 February 2021.

The implementation of the Amended Law Protecting the Privacy and Security of Citizens (2017) would undermine the democratic process, criminalize peaceful protests and remove various human rights protections. It would provide for broad and unchecked power to the military to arrest anyone without a warrant and aim to remove basic protections, including the rights to be free from arbitrary detention and from warrantless surveillance and search and seizure.

The amendments to the Penal Code and the Criminal Procedural Code have made non-bailable certain offenses, specifically targeting persons criticizing the coup or the military junta, as well as those encouraging others to support the “Civil Disobedience Movement.”

In addition, Amendments made to other existing laws, such as the Ward and Tract Administration Law and Electronic Transactions Law, allow for search and seizure at night without arrest warrant and allow for the silencing of critical voices against the coup and human rights violations of the military, in violation of international standards.

The ICJ calls on the Council to adopt a resolution, which, among other things, univocally condemns and demands the repeal of these laws and the return to of Myanmar civilian rule respecting the rule of law.

States break silence to condemn Egypt’s abuses at UN rights body

Non-governmental organizations (NGOs) from around the world expressed their strong support today for a joint declaration by UN member states condemning the human rights situation in Egypt which was delivered at the UN Human Rights Council.

In the declaration governments expressed “deep concern” for widespread human rights violations committed with impunity by the Egyptian authorities.

The joint declaration, signed by 31 states and delivered by Finland at the Council’s 46th session highlighted “restrictions on freedom of expression and the right to peaceful assembly, the constrained space for civil society and political opposition.” It also condemned the use of counter-terrorism laws to punish peaceful critics.

“The March 12 declaration ends years of a lack of collective action at the UN Human Rights Council on Egypt, despite the sharply deteriorating human rights situation in the country,” said Bahey Hassan, Director of the Cairo Institute for Human Rights Studies. “Countries should continue to make it clear to the Egyptian government that it will no longer have a carte blanche to arbitrarily imprison, torture or violate the right to life or unlawfully kill people.” 

More than  100  NGOs from around the world wrote to UN member states in early 2021, warning that the Egyptian government is attempting to “annihilate” human rights organizations and eradicate the human rights movement in the country through  sustained, widespread, and systematic attacks.

The organizations had asked UN member states to adopt a resolution establishing a monitoring and reporting mechanism on Egypt. The declaration delivered on March 12 is a significant step and should be followed up by concrete action toward achieving this goal, the organizations said. The declaration was on the Council’s agenda under Item 4, which provides a space to raise concerns about grave and systematic human rights violations, including country-specific situations.

The last joint declaration on the human rights situation in Egypt at the Human Rights Council was delivered by Iceland and co-signed by 26 countries in March 2014.

Since that time the human rights situation in Egypt has deteriorated dramatically. The Egyptian authorities have virtually obliterated almost all space for free expression, peaceful assembly, and association. Under President Abdel Fattah al-Sisi’s rule security forces, with the complicity of prosecutors and judges, have arrested, detained or prosecuted thousands, including hundreds of human rights defenders, religious minorities’ rights activists, peaceful protesters, journalists, academics, artists, politicians and lawyers.

Many have been forcibly disappeared, tortured or  otherwise ill-treated, and detained for months or years in inhumane conditions without trial.  Those detained are regularly held on the basis of unfounded terrorism-related charges. If referred to trial individuals are often  convicted in grossly unfair proceedings before military courts and through mass trials.  Many have been sentenced to death and executed after unfair trials that have relied on statements likely obtained through torture.  The authorities have also used morality and debauchery laws to arrest and detain women influencers, sexual violence survivors and witnesses, and LGBTI individuals and activists.

The UN Working Group on Arbitrary Detention has found that arbitrary detention is a systematic problem in Egypt. The UN Committee against Torture said in 2017 following an inquiry on Egypt that the facts gathered by the committee “lead to the inescapable conclusion that torture is a systematic practice in Egypt.”

“Today’s declaration sends a clear message to the Egyptian authorities that the world will no longer turn a blind eye to their relentless campaign to crush peaceful dissent. The authorities must take urgent action to comply with their obligations under international law, starting by releasing the thousands of men and women arbitrarily detained, protecting those in custody from torture and other ill-treatment, and ending the crackdown on peaceful activism, ” said Kevin Whelan, Amnesty International representative to the UN in Geneva.

In the March 12 joint declaration governments called for “accountability and an immediate end of impunity” for abuses.  Governments also called on Egypt to cease “abuses of due process,” the excessive use of “extended pre-trial detention,” and “the practice of adding detainees to new cases with similar charges after the legal limit for pre-trial detention has expired.”

Governments that have joined the declaration, led by Finland, include: Australia, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Canada, Costa Rica, Czech Republic, Denmark, Estonia, France, Germany, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Montenegro, the Netherlands, New Zealand, North Macedonia, Norway, Slovenia, Spain, Sweden, Switzerland, the United Kingdom, and the United States of America. Other governments can join the declaration until two weeks after the end of the current Human Rights Council session.

Bringing the human rights situation in Egypt to the attention of the Human Rights Council and properly addressing these abuses is of fundamental importance to ensure Egypt’s long-term stability and the dignity of its people,” said John Fisher, Geneva Director at Human Rights Watch.
