The ICJ, in an oral intervention before the Human Rights Council on 29 November 2006, requested reinforcement of the capacity of the Special Adviser to the Secretary-General on the Prevention of Genocide to serve as early warning in the prevention of genocide.

Document submitted by the ICJ to the UN Human Rigths Council “Working Group on the issue of reviewing and, where necessary, improving and rationalizing all mandates, mechanisms, functions and responsibilities in order to maintain a system of special procedures, expert advice and a complaint procedure” on 1 December 2006.

In its November 2006 written submission to this instance, the ICJ analyses the international law obligations of the United States in relation to renditions.
The ICJ also analyses the human rights obligations of European states which actively co-operate in renditions or secret detentions, or fail to take adequate steps to protect against them.
It concludes that, in light of the systematic nature of the breaches of norms of higher international law, including the prohibition against torture, involved in the system of renditions and secret detentions, there are obligations on European states, not only to refrain from co-operation with or recognition of this system, but to take co-operative measures to bring the situation to an end. The authors suggest that in the text, the words “gender identity and expression” are added after the word “gender”.
