The Sri Lankan government should end the targeted arrests, intimidation and threats against the lives and physical security of lawyers, activists, human rights defenders and journalists, the ICJ and 9 other international human rights organizations said today.
A campaign of fear has intensified since the 2019 presidential election, and has cast a shadow over the 2020 parliamentary election campaign.
The United Nations, as well Sri Lanka’s partners and foreign donors, should immediately call for full respect, protection and fulfillment of the human rights of all Sri Lankans, and particularly to halt the reversal of fragile gains in the protection of human rights in recent years.
Numerous civilian institutions, including the NGO Secretariat, have been placed under the control of the Defence Ministry. Serving and retired military officers have been appointed to a slew of senior government roles previously held by civilians.
The authorities have recently established military-led bodies such as the Presidential Task Force to build “a secure country, disciplined, virtuous and lawful society,” which has the power to issue directives to any government official. This represents an alarming trend towards the militarization of the state.
Many of those in government, including the president, defense secretary, and army chief, are accused of war crimes during the internal armed conflict that ended in 2009.
Since the presidential election in November 2019, anti-human rights rhetoric intended to restrict the space for civil society has been amplified by senior members of government.
On 6 July 2020, at an election rally, Prime Minister Mahinda Rajapaksa stated that “NGOs will be taken into a special attention under the new government formed after the General Election, specifically, how foreign monies and grants are received to the NGOs from foreign countries and further, activities of the international organizations will be observed.”
The government has also announced a probe into NGOs registered under the previous government.
In the months following the November 2019 presidential election, a number of organizations reported visits from intelligence officers who sought details of staff, programs and funding, in particular, organizations in the war-affected Northern and Eastern provinces of the country. Such visits are blatant attempts to harass and intimidate Sri Lankan civil society.
In February, the acting District Secretary in the Mullaitivu District (Northern Province) issued a directive that only non-governmental organizations with at least 70 percent of their activities focused on development would be allowed to work, effectively enabling arbitrary interference with and prevention of a broad range of human rights work.
A Jaffna-based think-tank was visited several times, including soon after the Covid-19 lockdown, and questioned about its work, funding and staff details.
Lawyers taking on human rights cases have been targeted through legal and administrative processes and have faced smear campaigns in the media.
Journalists and those voicing critical opinions on social media, have been arbitrarily arrested. The UN High Commissioner for Human Rights expressed alarm at the clampdown on freedom of expression, including the 1 April announcement by the police that any person criticizing officials engaged in the response to Covid-19 would be arrested.
It is unclear whether there is any legal basis for such arrests. The Human Rights Commission of Sri Lanka has cautioned against “an increasing number of such arrests since the issuing of a letter dated 1 April 2020”.
The targeting and repression of journalists and human rights defenders is not only an assault on the rights of these individuals, but an attack on the principles of human rights and the rule of law which should protect all Sri Lankans.
These policies have a chilling effect on the rights to freedom of expression and association, which are crucial for the operation of civil society and fundamental to the advancement of human rights.
Those working on ending impunity and ensuring accountability for past crimes, and especially victims, victim’s families, members of minority communities, and networks in the Northern and Eastern provinces, are particularly at risk of intimidation and harassment.
The Sri Lankan authorities must end all forms of harassment, threats, and abuse of legal processes and police powers against lawyers, human rights defenders and journalists. Human rights defenders living and working in Sri Lanka should be able to carry out their peaceful human rights work without fear of reprisals, which requires a safe and enabling environment in which they can organize, assemble, receive and share information.

The Swiss Section of the ICJ sent today to the Swiss Parliament (National Council) a letter warning that, if approved, the current Draft Federal Law on Police Measures against Terrorism, tabled before them would clash with the country’s obligations under international human rights law. The ICJ supports this initiative of its Swiss Section.
The letter outlines several key concerns with the legislative proposal that could be used to unduly restrict aspects of freedom of expression, the right to liberty, and the rights of the child , in contravention of international law guarantees.
The National Council holds today a crucial discussion on the draft legislation.

The ICJ today urged the country’s authorities to take immediate measures to fully reconstitute the Zimbabwe Human Rights Commission (ZHRC) after its operations were effectively suspended following the expiry of the terms of office of four of its Commissioners on 7 May 2020.
One Commissioner had already resigned in 2018 meaning that the ZHRC no longer has the constitutionally required quorum for it to make certain decisions that are fundamental to the protection of human rights in Zimbabwe.
“The inability by the ZHRC to fully execute its constitutional mandate has serious implications on the ability of individuals -in particular victims of human rights violations -to access justice,” said Arnold Tsunga, Director of the ICJ Africa Programme.
“The role of ZHRC, as Zimbabwe’s national human rights institution is critical in providing an avenue for redress to victims of human rights violations and the general public,” he added.
Zimbabwe has been witnessing an escalation of human rights violations requiring investigation by a fully functioning and effective Commission.
This spate of human rights violations has had a disproportionate impact on the poor and economically vulnerable in the context of the Covid-19 lockdown measures.
There have been an increase in targeting of human rights defenders, civil society leaders and political opposition, which have included acts of enforced disappearance and torture and other ill-treatment.
The ICJ underlined that while redress for such violations required strong and independent judiciary as a guarantor of human rights, the role of fully functional ZHRC was critical to complement that of the judiciary.
The ICJ called upon the authorities in Zimbabwe, and in particular the Parliamentary Committee on Standing Rules and Orders, to act expeditiously to ensure that the vacant positions are filled without any further delay to enable the ZHRC effectively perform and discharge its constitutional mandate.
The ICJ said that failure by the responsible authorities to act expeditiously to fill the vacant positions violated the core values and principles the Constitution of Zimbabwe, in particular section 324 of the Constitution which provides that “all constitutional obligations must be performed diligently and without delay”.
In addition, the President to fill in any vacant position within three months of death or resignation of a Commissioner. The position of Commissioner Khombe became vacant on the 30 October 2018, and has not been filled to date.

The ZHRC is established as an independent institution under Chapter 12 of the Zimbabwe constitution with the general objective to “support and entrench human rights and democracy; to promote constitutionalism; to promote transparency and accountability in public institutions; to secure the observance of democratic values and principles by the State and all institutions and agencies of government, and government-controlled entities; and to ensure that injustices are remedied.”
On 26 May the Chairperson of the ZHRC, Dr. E.H Mugwadi, wrote a letter notifying “partners and stakeholders” of the retirement of four Commissioners, namely Dr Ellen Sithole (former Deputy Chairperson), Dr Joseph Kurebwa, Kwanele M. Jirira and Japhet Ndabeni-Ncube with effect from 7 May. The Chairperson noted that the retirement had left the Commission lacking the quorum to fulfil its constitutional obligations, particularly with respect to make policy resolutions and the adoption of monitoring and investigation reports. The Commission had also been unable to adopt Commission reports its activities.
International standards for effective and credible National Human Rights Institutions (NHRIs) are contained in the United Nations Principles relating to the Status of National Institutions (Paris Principles), which provide that NHRIs must be adequately resourced with sufficient institutional capacity to perform and discharge their responsibilities.

Kazakhstan National University (KazNU) Human Rights Institute in cooperation with the ICJ, the European Association of Lawyers and other partners will hold an online international conference “Law and human rights during the pandemic”.
The event will assemble leading legal experts and practitioners from Central Asia and other countries who will discuss the most pertinent issues for ensuring human rights and access to justice in times of pandemic.
The topics will include sections on human rights during quarantine and emergency situations, and administration of justice during the pandemic.
The event is open for participation upon online registration.
The working language of the event is Russian. The conference will start at 11.00 Nur-Sultan time (GMT +5).

The ICJ, the International Bar Association’s Human Rights Institute (IBAHRI), and the Centre for Civil and Political Rights (CCPR Centre) today published a legal opinion by ICJ Commissioner Professor Sarah Cleveland, on compliance of Kazakhstan’s Draft Law on the Procedure for Organising and Holding Peaceful Assemblies, with the Republic of Kazakhstan’s international human rights obligations.
“Excessive restrictions on freedom of peaceful assembly in Kazakhstan have been of significant concern to the UN Human Rights Committee, the Venice Commission of the Council of Europe, and other human rights bodies for many years,” said Sarah Cleveland.
“Kazakhstan now has an important opportunity to bring its law into compliance with its international human rights obligations, but the draft law currently being considered does not achieve this.”
The Opinion finds that the proposed legislation includes of number of restrictions on freedom of assembly that are fundamentally contrary to Kazakhstan’s human rights obligations, including (1) excessive notification and approval requirements; (2) excessive authority to ban an assembly; (3) a prohibition on spontaneous assemblies; (4) restriction of assemblies to specific locations; (5) preferential treatment for assemblies organized by the government; (6) a prohibition against foreigners, refugees, stateless persons from organizing or participating in assemblies, (7) excessive obligations on organizers and participants; and (8) excessive sanctions for organizers and participants. The timing and process for adopting a law that so fundamentally impacts domestic compliance with core human rights obligations itself raises serious human rights concerns, given the limited ability of civil society organizations and the general public to participate in a robust public debate regarding the law during the quarantine.
In light of these serious human rights concerns, the IBAHRI, the ICJ and the CCPR Centre urge the Senate and/or the President of the Republic of Kazakhstan to halt consideration of the Draft Law, and to seek guidance from the OSCE/ODIHR Panel of Experts on Freedom of Assembly and Association, the Office of UN High Commissioner on Human Rights, and/or the Venice Commission regarding how the current law on freedom of peaceful assembly might be revised consistent with Kazakhstan’s international human rights obligations.
