Prosecution strategies in situations of transition, military courts: UN statement

The Colombian Commission of Jurists, an ICJ affiliate, delivered an oral statement during the Interactive Dialogue with the UN Special Rapporteur on Truth, Justice, Reparations and Guarantees of Non-recurrence, and the Working Group on Arbitrary Detention, at the Human Rights Council.

The statement welcomes the reports of both Special Procedures, noting especially in relation to the report of the Special Rapporteur on Truth concerning prosecutorial strategies, in particular, recalling the general obligation of all states to investigate and hold accountable perpetrators of violations of international human rights and humanitarian law, recognizing the importance of independence and impartiality of prosecutors and judicial actors, and reaffirming the rights of victims to be involved. The statement also welcomes the Working Group’s comments on the issue of military courts, and joins its call for the Council to adopt principles on military courts along the lines of those proposed to the UN in 2006 by expert Emmanuel Decaux.

The statement illustrates these points with examples from Colombia.
