The ICJ in its intervention of 16 June 2008 expressed concerns at continuing excessive, disproportionate, and indiscriminate use of force by the Israeli Defence Force (IDF) and the Palestinian armed groups.
The ICJ condemned attempts to reinterpret the humanitarian law principles of distinction and proportionality, as well as deliberate targeting of civilians and objects indispensable to the survival of the civilian population without any legitimate military advantage at all. It also denounced the siege on Gaza and urged to prevent the growth of illegal settlements and address the issue of refugees.

” The Six leaders of the Baha’i faith in Iran, who were arbitrarily arrested in Tehran in May 2008 and are being held incommunicado, must be released immediately or legally charged with a recognisable offence,” said the ICJ.

The ICJ is concerned by developments in the region, resulting in a series of violations of international humanitarian law.
In its intervention of 6 March 2008, the ICJ expressed concerns at Israel’s indiscriminate and disproportionate use of force in violation of international humanitarian law and Palestinian armed groups’ continuous indiscriminate attacks on military and civilians by firing of rockets in southern Israel, which violate international humanitarian law. In addition, the ICJ condemned Israel’s siege on Gaza. As the ICJ concluded its mission to Israel and the West Bank that day, it also shared its concerns at the Israeli settlements, the rule of law and human rights situation in the Occupied Palestinian Territories (OPTs) and the emergence of two different and separate legal systems in the OPTs.
