In a report issued today, the ICJ calls on the authorities in Iraq not only to prosecute those responsible for gross human rights violations but also to uphold the rights of the victims to reparation and truth.

La détention arbitraire et la condamnation de l’avocat Me Mohammed Abbou pour avoir exercé ce droit constitue un paradoxe en regard des principes mêmes sur lesquels se fonde le SMSI.
Me Abbou a été condamné en avril 2005 à trois ans et demi de prison lors d’un procès inique portant sur deux chefs d’accusation. Suite à la publication d’un article en août 2004 dans lequel il comparait les conditions de détention dans les prisons tunisiennes avec celles d’Abu Ghraib en Iraq, Me Abbou a été condamné pour « publication d’écrits de nature à troubler l’ordre public » et pour « diffamation d’instances judiciaires ».
Une semaine avant le procès, il a aussi été accusé d’avoir agressé une avocate en juin 2002 – une accusation qui n’a pu être prouvée. La condamnation a été confirmée en juin 2005.
