Today, the Lebanese Center for Human Rights (CLDH) and the ICJ held a joint webinar on migrants and refugees in Lebanon. The organizations addressed the situation of migrant workers and refugees including their legal and social status and the violations to which they are exposed.
The ICJ and CLDH called on the Lebanese authorities to adopt and enforce just, fair and effective legal and policy frameworks to address the entry and stay of refugees and migrants in Lebanon, and ensure the protection of their human rights in full compliance with Lebanon’s obligations under international law, particularly their non-refoulement obligations.
The ICJ launched its recent report Unrecognized and Unprotected: The Treatment of Refugees and Migrants in Lebanon, which undertakes an assessment of the Lebanese legal framework governing the treatment of migrants and refugees in the country, including their entry and stay.
The report concludes that the legal and policy gaps, together with the executive’s excessive and unchecked powers in shaping and implementing migration-related policies, have led to serious violations to refugees’ and migrants’ human rights in Lebanon.
The ICJ presented the findings and key recommendations of its report, which included urging the Lebanese government to ensure that no individual is transferred to a country where he or she faces a real risk of persecution or other forms of serious harm, such as torture or other cruel, inhuman or degrading treatment or punishment.
Procedural obstacles preventing migrant workers and refugees from accessing justice, such as lacking residency papers, were examined by CLDH.
The webinar, facilitated by CLDH’s Executive Director Fadel Fakih, commenced with opening remarks from Said Benarbia, Director of the ICJ’s Middle East and North Africa Programme, and Wadih Al-Asmar, President of CLDH. Attendees included civil society, lawyers, and members of the Lebanese Bar association.
Underscoring that Lebanon is obligated to protect the rights of refugees and asylum seekers despite not being a State party to the 1951 Refugee Convention, as these rights are guaranteed by other international conventions ratified by Lebanon including the International Covenant on Civil and Political Rights (ICCPR) and the UN Convention against Torture and other Cruel, Inhuman and Degrading Treatment or Punishment (UNCAT), Al-Asmar called on the Lebanese State to abandon its repressive security approach towards refugee populations, and to abolish the exploitative Kafala sponsorship system.
Benarbia addressed how normative gaps, together with restrictive provisions of the 1962 Law of Entry and Exit, including those criminalizing “irregular entry,” undermine the right of refugees to an individual examination of their asylum claim, their right to liberty and security of person, and their right to an effective legal remedy for human rights violations.
He pointed out that laws and policies impacting on migrants and refugees should be adopted and implemented by legally constituted civilian authorities, subject to legislative oversight and judicial review.
CLDH members Hasna Abdul Reda and Rabih Keyrouz focused on the obstacles that continue to impede migrant workers and refugees from accessing justice in Lebanon. CLDH Programme Manager, Josiane Noun, presented CLDH’s Legal Aid Programme and support services that the organization has made available to migrant workers and refugees.
Kouakou Adjo Delphine, representing the Alliance of Migrant Domestic Workers in Lebanon, discussed the challenges domestic migrants face in accessing justice for human rights violations.
The conference concluded with an open discussion between panelists and participants where possible solutions to enhance the protection afforded to migrant workers and refugees in Lebanon were discussed.

The ICJ and ECRE intervened today before the Grand Chamber of the European Court of Human Rights in the case of the extradition of a Kyrgyz national of Uzbek ethnicity back to his country of origin where he would be at risk of torture or other forms of ill-treatment .
In their submissions, the ICJ and the European Council on Refugees and Exiles (ECRE) analysed thenon-refoulement obligations of the Russian Federation under international human rights law in relation to the consideration of evidence to assess the substantial grounds to believe that a concerned person will face real risk of a serious human rights violation; and the use of diplomatic assurances purportedly to protect against torture and other serious human rights violations in light of international law.
The two NGOs also provided the Court with an update on the legal framework governing extraditions from the Russian Federation to Central Asian States, in particular Kyrgyzstan, as well as Russia’s extradition practice. They concluded that the analysis of the law and practice revealed a number of critical human rights deficits.
They submitted that the lack of respect for the procedural aspect of the principle of non-refoulement, the consequent ineffectiveness of domestic remedies in this regard, in the Russian Federation, and the abysmal record of Kyrgyzstan in upholding its obligation to respect and protect the prohibition of torture or other ill-treatment mean that extraditions from the Russian Federation to Kyrgyzstan entail a high risk of violations of both substantive and procedural aspects of the principle of non-refoulement.
These submissions are an update of the third party intervention submitted by the ICJ before the Chamber of the European Court of Human Rights on 22 September 2016. The Chamber had ruled that no risk of breach of the principle of non-refoulement existed in the case but the judgment is now subject to the review of the Grand Chamber.

The ICJ today called on the Greek authorities to withdraw their decision to close its border with Turkey for “national security” reasons as it constitutes a clear breach of the country’s obligations under international refugee and human rights law as well as EU law.
Prime Minister Kyriakos Mitsotakis has ordered the closure of the border with Turkey for “national security” reasons as thousands of refugees have been arriving at the border with Greece.
The ICJ said that the decision to close the border to migrants and refugees coming from Turkey breaches their right to seek asylum, the principle of non-refoulement and the prohibition of collective expulsion, which Greece must uphold under international human rights and refugee law and the EU Charter.
“Any violence and push-backs occurring at the border and at sea must stop and the persons responsible for acts of violence must be duly investigated and prosecuted. Respect for human rights principles that form part of the EU’s founding values require that refugees are not pushed back at the borded,” said Massimo Frigo, Senior Legal Adviser for the ICJ Europe and Central Asia Programme.
“Assistance should be centred on fostering access to asylum and not on strengthening border control where, in the current situation, EU authorities, such as Frontex, risk assisting in human rights violations,” he added.
The ICJ calls on the European Union to immediately set up a relocation plan with the Greek authorities to allow them to properly process asylum applications without placing refugees in dire reception conditions, such as those existing for refugees on the Greek islands.
The ICJ, together with ECRE and the Greek Refugee Council has launched a complaint against Greece before the European Committee of Social Rights on the degrading conditions of migrant children in Greece (ICJ and ECRE v. Greece).
Background
The movement of refugees comes after the declaration by President Recep Tayip Erdogan not to continue to retain on its territory Syrian refugees under the so-called “EU-Turkey statement”, following the armed conflict in Idlib (Syria).
Under this “statement”, Turkey had previously agreed to retain Syrian refugees on its territory and to accept Syrian refugees that reached Greek territory without their request of international protection being examined by the Greek authorities.
On the basis of the same “statement”, the EU had agreed to resettle some of the Syrian refugees in its Member States.

The ICJ has presented information to the UN Committee against Torture in preparation for the Committee’s examination of the fifth periodic report of Uzbekistan under the International Covenant on Civil and Political Rights (ICCPR).
In its submission, the ICJ addresses Uzbekistan’s legislation on extradition, its potential discrepancies with international law.
The ICJ welcomes the recent ratification of the Commonwealth of Independent States (hereafter, “CIS”) Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters 2002, known as the Chisinau Convention, as a positive step towards the compliance of the country’s extradition system with international standards
In it report, the ICJ formulates the following recommendations to Uzbekistan:
- Fully implement human rights and procedural safeguards and guarantees in extradition proceedings or in connection with other types of transfers, and interpret and apply such safeguards in accordance with Uzbekistan’s international human rights law obligations. In particular, Uzbekistan should take all necessary measures to fully implement the human rights guarantees featured in the Chisinau Convention into its domestic legislation.
- Implement the necessary reforms to give judicial authorities the central decision-making role in extradition proceedings, and ensure their full independence both at an institutional and personal level, in law and in practice. Extradition decisions should be taken by prosecutors only if they enjoy the same level of independence as judges, in law and in practice.
- Ensure that individuals extradited to face trial in Uzbekistan courts are awarded the full protection of the Convention.
- Take effective measures to prevent torture and other forms of ill-treatment, including by ensuring compliance with the non-refoulement principle in extradition proceedings.
- Carry out effective, independent and impartial investigations with a view to identifying persons directly and indirectly responsible for rendition operations and abduction practices, as they violate human rights and involve crimes under international law. Those responsible should be prosecuted, tried and, if convicted, sentenced to punishments commensurate with the gravity of their crimes, and to appropriate administrative sanctions to ensure non-repetition.
