Hoy, la CIJ pidió à la Oficina de la Alta Comisionada para los Derechos Humanos de asegurar transparencia y participación de sus actividades en Venezuela, durante el dialogo sobre la actualización oral de Alta Comisionada para los Derechos Humanos sobre la situación en Venezuela

“Señora Presidenta,
La Comisión Internacional de Juristas agradece la actualización oral de la Alta Comisionada sobre la situación en Venezuela, particularmente respecto de la cooperación entre su oficina y las autoridades venezolanas.
La CIJ subraya la importancia de la transparencia en las actividades realizadas bajo el Memorándum de Entendimiento (MDE) firmado por ambas partes. La publicación del MDE para informar al público y asegurar el óptimo involucramiento de las partes interesadas, es fundamental para su éxito.
La CIJ enfatiza que además de los derechos civiles y políticos, los derechos económicos sociales y culturales continúan siendo violados en Venezuela; esta situación se ha visto agravada por la pandemia de COVID-19. En enero de 2021, al menos 37 trabajadores habían fallecido debido a la falta de equipos de protección y suministros básicos en los centros de salud.
Además, a la luz de los recientes anuncios de autoridades venezolanas, parecen existir consideraciones políticas en las prioridades del plan de vacunación contra la COVID-19, en lugar de criterios objetivos y de salud pública, lo que podría dar lugar a discriminación y denegación de igual protección ante la ley.
La CIJ recomienda que la Alta Comisionada monitoree y reporte sobre el cumplimiento de sus recomendaciones previas que fueron realizadas a las autoridades estatales, así como sobre el involucramiento más amplio de su oficina con organizaciones de la sociedad civil local, con miras a proteger los derechos humanos

Today, the ICJ called on the Office of the High Commissioner for Human Rights to guarantee transparency and participation in its activities in Venezuela in an oral statement delivered during the interactive dialogue on the oral update by the UN’s High Commissioner of Human Rights on Venezuela.
The statement reads as follows:
“Madame President,
The International Commission of Jurists (ICJ) welcomes the High Commissioner’s oral update on the situation of human rights in Venezuela, particularly regarding the cooperation between her office and the Venezuelan authorities.
The ICJ underscores the importance of transparency on the activities conducted under the Memorandum of Understanding (MoU) signed by both parties. Publication of the MoU to inform the public and ensure the optimal engagement of stakeholders is critical to its success.
The ICJ stresses that in addition to civil and political rights, economic, social, cultural rights continue to be violated in Venezuela, a situation aggravated by the COVID-19 pandemic. As of January 2021, at least 37 health workers have died due to the lack of protective equipment and basic supplies in healthcare centers.
In light of recent announcements by Venezuelan authorities, political considerations appear to be a driving factor in the COVID-19 vaccine prioritization plan, instead of objective and public health criteria, which could lead to discrimination and a denial of equal protection of law.
The ICJ recommends that the High Commissioner monitor and report on the status of the Venezuelan authorities’ compliance with her previous recommendations, and on her broader engagement with local civil society with a view to protecting human rights.

Hoy, la CIJ alertó el Consejo de Derechos Humanos de la ONU sobre la persistencia de las graves y generalizadas violaciones a los derechos humanos en Venezuela, en el contexto du un dialogo sobre actualización oral de la Misión Internacional Independiente para la Determinación de los Hechos sobre la situación en Venezuela.
La declaración oral:
“Señora Presidenta,
La Comisión Internacional de Juristas (CIJ) agradece la actualización oral presentada por la Misión Internacional Independiente para la Determinación de los Hechos (FFM) acerca de la situación en Venezuela.
La CIJ llama la atención sobre la persistencia de las graves y generalizadas violaciones a los derechos humanos reportadas por la FFM en su informe de 2020, incluyendo las ejecuciones extrajudiciales.
Las autoridades venezolanas han incumplido totalmente las recomendaciones de la Misión, incluida la necesidad de realizar “investigaciones rápidas, eficaces, exhaustivas, independientes, imparciales y transparentes de las violaciones de los derechos humanos y los delitos”. Esto resalta el déficit de independencia de los jueces y de los fiscales, lo que ha socavado el derecho a un juicio justo.
La CIJ está extremadamente preocupada por los ataques a defensores de derechos humanos y organizaciones de la sociedad civil en Venezuela por parte de las autoridades, que incluyen la criminalización de la defensa de los derechos humanos, siendo que esta defensa está protegida por el derecho internacional de los derechos humanos. Las organizaciones afectadas en 2020 incluyen a “Acción Solidaria”, “Provea”, “Alimenta la Solidaridad” y “CONVITE”, y a principios de este año cinco miembros de “Azul Positivo” fueron detenidos arbitrariamente y continúan siendo acosados.
La CIJ insta a las autoridades venezolanas a garantizar su plena cooperación con la FFM y a cesar de inmediato los ataques contra defensores de derechos humanos; a realizar investigaciones independientes y llevar ante la justicia a los responsables de graves violaciones de derechos humanos; y a eliminar los obstáculos para el acceso a la justicia de las víctimas.

The ICJ delivered a statement today on the occasion of the interactive dialogue on the oral update by the Independent International Fact-Finding Mission on the situation in Venezuela calling for attention to the persistence of widespread serious human rights violations in the country.
The statements reads as follows:
“Madame President,
The International Commission of Jurists (ICJ) welcomes the Independent International Fact-Finding Mission’s oral update on the situation in Venezuela.
The ICJ calls attention to the persistence of widespread serious human rights violations, as reported by the FFM in its 2020’s report, including extrajudicial killings.
Venezuelan authorities have wholly failed to comply with the Mission’s recommendations, including the need for “prompt, effective, thorough, independent, impartial and transparent investigations into the human rights violations and crimes”.
This underscores the deficits in judicial and prosecutorial independence that has undermined fair trial rights.
The ICJ is extremely concerned about attacks on human rights defenders and civil society organizations in Venezuela by the authorities, which include the criminalization of the defence of human rights protected under international human rights law.
Civil society organizations that were targeted in 2020 include “Acción Solidaria”, “Provea”, “Alimenta la Solidaridad” and “CONVITE”, and early this year five members of “Azul Positivo” were arbitrarily detained and continue to be harassed.
The ICJ urges that the Venezuelan authorities ensure their full cooperation with the FFM and immediately cease the attacks on human rights defenders; conduct independent investigations and bring to justice those responsible for serious human violations; and remove obstacles to access to justice for victims.

Tunisian authorities must respect the rights to freedom of expression, association and peaceful assembly, and stop the systematic targeting of protesters, lawyers and civil society activists, said the ICJ today.

Since the outbreak of social justice protests on 15 January 2021, Tunisian security forces have systematically targeted protesters, including minors, lawyers and civil society activists.
Over the last weeks, reports of abuses at the hands of the Tunisian security forces have included: hundreds of arbitrary arrests; deaths in custody in disputed circumstances; physical assaults; rape and death threats; and refusing detainees access to legal counsel. While to date more than half of the people arrested since the beginning of the protests have been released, only a few prosecutions arising from the security forces’ systematic campaign of arrests have taken place, and hundreds of people are still in custody awaiting to be brought before a judge. According to the information available to the ICJ, individuals are being prosecuted under different charges, including “insulting the police” and “abuse of morals”.
“The systematic targeting of peaceful protesters and the other abuses that we have witnessed in recent weeks are clear instances of the wider impunity that Tunisian security forces have continued to enjoy over decades,” said Said Benarbia, the ICJ’s MENA Programme Director
“The Tunisian authorities should immediately halt these practices by reforming the country’s security legislation and open independent and impartial investigations into these abuses.”
To date, Tunisia has failed to adopt a comprehensive reform of its security legislation in line with the Constitution and the country’s obligations under international human rights law and standards.
As reported on multiple occasions, investigations into reports of human rights violations by Tunisian security forces have rarely led to successful prosecutions of perpetrators in the past. Moreover, while since 2018 prosecutions arising from police abuses committed under the previous regime have started before the Specialized Criminal Chambers, numerous obstacles continue to affect the progress of trials, and no verdict has been delivered to date.
“It is time for the Tunisian authorities to abide by the Constitution and international human rights law and standards and commit to a complete end to the security forces’ oppressive practices,” Benarbia added.
“Only by undertaking a full review of Tunisia’s security laws and bringing perpetrators of human rights violations to justice will the country be able to break this cycle of abuses and ensure full respect for fundamental freedoms and human rights.”
