ICJ submission on Universal Periodic Review of Colombia

The ICJ has brought to the attention of the UPR mechanism issues concerning Colombia’s responsibility to combat the persistent impunity of perpetrators of gross human rights violations, as well as other key issues to be addressed in the review of Colombia’s compliance with international human rights.

From 22 April to 3 May 2013, the Human Rights Council’s Working Group on the UPR will consider the situation of human rights in Colombia. Ahead of the Working Group’s review, the ICJ has made a submission in which it has made suggested recommendations concerning:

  • Combating impunity;
  • Reforms affecting access to justice for victims of human rights violations; 
  • Intimidation of human rights defenders; and
  • Colombia’s engagement with international human rights instruments and mechanisms.

ICJ submission on the Universal Periodic Review of Canada

The ICJ has brought to the attention of the Universal Periodic Review (UPR) mechanism issues concerning the activity of the Canadian business sector and its implications for human rights, as well as other key issues to be addressed in the review of Canada’s compliance with international human rights.

From 22 April to 3 May 2013, the Human Rights Council’s Working Group on the UPR will consider the situation of human rights in Canada. Ahead of the Working Group’s review, the ICJ has made a submission in which it has made suggested recommendations concerning:

  • Activities of the business sector and their implication for human rights as this relates to the mining sector and the recent Bill to impose guidelines on responsible and human rights compliant behaviour for Canadian mining, gas and oil companies operating overseas;
  • Use and exportation of asbestos to other States; and
  • Canada’s engagement with international human rights instruments and mechanisms.

The ICJ has brought to the attention of the Universal Periodic Review (UPR) mechanism issues concerning the independence and impartiality of the judiciary in Bangladesh, as well as other key issues to be addressed in the review of Bangladesh’s compliance with international human rights.

From 22 April to 3 May 2013, the Human Rights Council’s Working Group on the UPR will consider the situation of human rights in Bangladesh. Ahead of the Working Group’s review of Bangladesh, the ICJ has made a submission in which it has made suggested recommendations concerning:

  • Independence and impartiality of the judiciary;
  • Lack of transparent appointment procedures for public prosecutors;
  • Use of the Presidential pardon in cases concerning allegations of gross human rights violations; and
  • Bangladesh’s engagement with international human rights instruments and mechanisms.

ICJ comments on Universal Periodic Review of Russian Federation

The ICJ commented on the UPR of the Russian Federation, addressing issues including torture and ill-treatment, impunity, judicial independence, NGO laws and “homosexual propaganda” bans.

The International Commission of Jurists has brought to the attention of the Human Rights Council’s Working Group on the UPR and to the Human Rights Council issues concerning:

  • prevention of torture and ill-treatment and other gross human rights violations;
  • impunity for gross human rights violations;
  • independence of the judiciary; amendments to NGO laws;
  • non-refoulement; homosexual propaganda bans; and
  • Russia’s engagement with international human rights instruments and mechanisms.

ICJ and NJCM statement on adoption of the Universal Periodic Review of the Netherlands

ICJ and NJCM statement on adoption of the Universal Periodic Review of the Netherlands

In an interactive dialogue with representatives of the Government of the Netherlands, the ICJ and the Dutch section of the ICJ, the NJCM, called for greater consultation with civil society.

The ICJ and NJCM also urged the Netherlands to give human rights a prominent place in civic education.

The statement was delivered today during the adoption by the UN Human Rights Council of the Universal Periodic Review outcome document on the Netherlands, during the course of the 21st regular session of the Council.

In a submission to the Working Group, the ICJ has focused on the discrete issues of:

  1. the failure of the Lessons Learnt and Reconciliation Commission and previous national commissions of inquiry to hold accountable those responsible for serious human rights violations;
  2. the systemic barriers affecting the efficacy of the habeas corpus writ as legal remedy for arbitrary detention and enforced disappearance;
  3. the ongoing detention of Sri Lankans in “rehabilitation camps” and the lack of any independent monitoring mechanism;
  4. Sri Lanka’s failure to implement witness protection measures;
  5. Sri Lanka’s failure to properly incorporate the Convention Against Torture into domestic law; and
  6. Sri Lanka’s party status to international human rights instruments and its cooperation with the UN treaty bodies and the Council’s Special Procedures.

During the 19th session of the Human Rights Council, the ICJ made an oral statement during the Council’s consideration and adoption of the outcome document in the Universal Periodic Review of Zimbabwe.

The statement focussed on the lack of human rights protection and respect for the rule of law in the country, particularly as this affects lawyers, journalists and human rights defenders more broadly, and called on the Government of Zimbabwe to halt the repression of legitimate peaceful protests and undertake reforms necessary for the conduct of independent and effective investigations into gross human rights violations and crimes under international law.

During the 19th session of the Human Rights Council, the ICJ made an oral statement during the Council’s consideration and adoption of the outcome document in the Universal Periodic Review of Thailand.

The statement focussed on issues of impunity and special security laws operating in the southernmost provinces of Thailand, and called on the Government of Thailand to abolish provisions of the Marshal Law Act and Emergency Decree concerning immunity for State officials and to review security laws.

During the 19th session of the Human Rights Council, the ICJ made an oral statement during the Council’s consideration and adoption of the outcome document in the Universal Periodic Review of Syria.

The statement focussed on the lack of investigations into human rights abuses, including ongoing gross human rights violations, and called on UN bodies responsible for peace and security and human rights to take effective measures to allow regular access for humanitarian assistance, including essential supplies of food, water and medicines.

ICJ oral intervention on the adoption of the outcome document of the Universal Periodic Review of Greece

The UN Human Rights Council adopted the outcome document of the Universal Periodic Review (UPR) of Greece.

The ICJ made a statement during this adoption process, urging the implementation of recommendations accepted by Greece related to protecting the rights of asylum seekers, particularly concerning their treatment in Greece.

It also called on Greece to reconsider its decision to reject the recommendation of the UPR Working Group that Greece accede to the International Convention on the Protection of the Rights of Migrant Workers and their Families.
