International Women’s Day: ICJ and its Commissioners advancing gender justice

Today on International Women’s Day the world looks to celebrate the achievements of women and advances made towards the realization of women’s human rights but the day is also an opportunity to address the issues that continue to disadvantage women.

In the 70th anniversary year of the Universal Declaration of Human Rights many women around the world have seen States failing to live up to their obligations to ensure that they are able to exercise their human rights.

Where women’s human rights are violated many women face discrimination, denial of equal protection of the law and other impediments in accessing the justice that they deserve.

“The ICJ has a strong commitment to addressing the obstacles women face in accessing justice,” said ICJ Acting Vice-President, Justice Radmila Dragicevic-Dicic.

“The judiciary has an important role in protecting the rights of women, but in many States there is a lack of proper awareness and understanding of issues such as gender based-violence.  Many judges would benefit from judicial education on specific gender-based issues to ensure that women victims are made visible and their rights protected by domestic laws and relevant international standards,” she added.

For several years the ICJ has worked on women’s access to justice issues in different countries in all regions with a variety of stakeholders, including human rights defenders, lawyers, judges, governmental authorities and international rights experts and mechanisms.

For example, in Tunisia, the ICJ issued a memorandum calling on authorities to remove the obstacles women face in accessing justice.

The ICJ has held regional dialogues in Africa and Asia with judges and lawyers.

In Asia, one outcome of this was The Bangkok General Guidance for Judges in Applying a Gender Perspective, designed to assist judges in employing a gender perspective in deciding cases before them, which has since been adopted for use by judiciaries in Indonesia and the Philippines.

In Africa, the need for gendered perspectives in judicial decision-making was also raised in a regional report evaluating sexual and gender based violence (SGBV) and fair trial rights.

The ICJ has undertaken substantial work on women’s access to justice in the context of SGBV, including a report calling for an eradication of harmful gender stereotypes and assumptions and a Practitioners’ Guide on Women’s Access to Justice for Gender-Based Violence.

Both have been used as training tools in Asia, Africa and MENA, most recently at a workshop on SGBV in Swaziland.

Last year the ICJ released a memorandum on effective investigation and prosecution of SGBV in Morocco.

The ICJ has also undertaken trial observations during hearings in the landmark Sepur Zarco case, the first case that resulted in a conviction for sexual crimes that had occurred during Guatemala’s internal conflict in the early 1980s.

The ICJ regularly engages with the UN Human Rights Council and the UN Committee on the Elimination of all Forms of Discrimination against Women to highlight issues around women’s access to justice and call on the international community to be vigilant in upholding women’s rights protections.

“The ICJ is lucky to count among its number some very impressive women human rights defenders, who bring a great deal of expertise to the work of the organization,” said Dragicevic-Dicic.

“The five most recent additions to the ICJ have further strengthened the organization’s ability to speak authoritatively on women’s rights, and I look forward to working with my new colleagues to enhance women’s access to justice,” she added.

The new additions to the ICJ include Dame Silvia Cartwright, Former Governor of New Zealand; Professor Sarah Cleveland, Constitutional and Human Rights Professor at Columbia Law School in the USA; Justice Martine Comte who has over 30 years judicial experience in France; Mikiko Otani, member of the UN Committee on the Rights of the Child from Japan; and Justice Lillian Tibatemwa-Ekirikubinza from the Supreme Court of Uganda.

In an interview with the ICJ, Commissioner Justice Elizabeth Evatt, a distinguished Australian lawyer, jurist and trailblazer for women in the legal profession in her country, spoke about the importance of women being able to access justice.

One of the architects of Australia’s Family Law Act of 1975, Justic Evatt told the ICJ how the Act made divorce more accessible and abolished the Common Law relics that gave men greater rights over women, however new problems have emerged since then.

Justice Evatt explained that “(the Act) was an extremely important reform for women. It made it far easier for men and women to access divorce and have their matters dealt with because the court had conciliation and counselling services and also legal aid was more readily available. But I am afraid that since those days, thing have changed. The Family Court is now beset with delays and obstacles and it is impossible for people to get legal aid. People have to take their case on their own or face huge legal costs, so having begun well, it hasn’t continued well. More resources are needed.”

Justice Evatt also considers that there is a need for the government and the judiciary to take more action to address domestic violence.

However, she noted, “there has been a change over the years with a growing awareness of both the police and the local courts, which are the main ones dealing with violence. They have become far more aware of the need to take action to protect women and prevent violence but the cure for domestic violence does not lie just with the courts but also with the whole of society.”

Pakistan: UN review highlights human rights failures

Pakistan’s third Universal Periodic Review (UPR) has drawn global attention to a number of serious human rights failures in the country, said the ICJ today.

On 16 November, the UPR Working Group of the Human Rights Council adopted a draft UPR outcome report for Pakistan. Pakistan received a total of 289 recommendations – a substantial increase from its previous UPR in 2012, when Pakistan received 167 recommendations. As many as 111 State delegations took the floor to make statements, and 14 States submitted their questions in advance.

“That well over a hundred delegations participated in the review indicates the global community’s interest in Pakistan’s human rights situation,” said Frederick Rawski, ICJ’s Asia Director.

Key recommendations urge Pakistan to:

  • Reinstate a moratorium on executions with the view to abolishing the death penalty;
  • Repeal or amend “blasphemy laws” to bring them in line with international human rights law;
  • Ratify the International Convention for the Protection of All Persons from Enforced Disappearance and a number of other human rights treaties;
  • Ensure effective protection of the rights of religious minorities, human rights defenders, journalists and other vulnerable groups;
  • Strengthen the National Commission for Human Rights;
  • Ensure prompt, impartial and effective investigations of human rights violations and bring perpetrators to justice;
  • Set 18 as the minimum legal age for marriage; and
  • Ensure effective implementation of laws on violence against women.

“The States’ recommendations echo the concerns of dozens of civil society organizations and even the National Commission of Human Rights – who all agree that the Government must take urgent measures to address the downward spiral of rights in the country”, Rawski said.

Pakistan will now examine the recommendations and respond to the Human Rights Council at latest by the Council’s next session in March 2018.

Pakistan’s review comes at a time of serious concern about the rights situation in the country.

The Government lifted the informal moratorium on the death penalty and carried out nearly 500 executions in less than three years – among the highest execution rates in the world; Parliament enacted laws allowing military courts to try civilians for certain terrorism-related offences in secret trials; and the authorities started a new wave of crackdowns on NGOs, journalists and human rights defenders, including subjecting them to enforced disappearance.

Persecution of religious minority communities also continues despite the Government’s claims that religious minorities “enjoy equal rights as equal citizens of Pakistan”. Last month, three Ahmadi men were sentenced to death for blasphemy for allegedly scratching anti-Ahmadi pamphlets that had the “Mohr-e-Nabbuwat” (seal of the Prophet Muhammad) printed on them. And earlier this week, the Islamabad High Court directed the Government to respond to a petition demanding a separate database for Ahmadis in the civil service to ensure they are not “posted in offices involving sensitive matters”.

“As a member of the Human Rights Council, Pakistan is expected to uphold the highest standards in the promotion and protection of human rights, something it has clearly failed to do,” added Rawski.

“Pakistan should make use of this process by accepting the recommendations made during the review and adopting a concrete, action-based national human rights plan to ensure their effective implementation.”

UN Member States reviewed Pakistan’s human rights record for the third time on Monday, 13 November, through the UPR process.

The UPR is a unique mechanism of the UN Human Rights Council aimed at improving the human rights situation of each of the 193 UN Member States. Under this mechanism, the human rights record of all UN Member States is peer-reviewed every four to five years by the UPR Working Group, consisting of the 47 UN Member States of the Human Rights Council; however, any UN Member State can take part in the discussions and the dialogue during the UPR of the reviewed States. States then make recommendations to the country under review, which has the option of accepting or noting the recommendations.

Pakistan: election to UN rights body spotlights failings

The ICJ, Amnesty International and Human Rights Watch are urging Pakistan to take immediate steps towards meeting “the highest standards in the promotion and protection of human rights,” following the country’s election to the Human Rights Council.

Today, the UN General Assembly selected 15 states to serve as members of the UN Human Rights Council from January 2018 to December 2020.

From the Asia-Pacific region, Nepal, Qatar, Afghanistan and Pakistan were selected out of five candidates.

To secure the UN Human Rights Council membership, Pakistan pledged its commitment to the promotion and protection of human rights.

However, the pledge failed to address directly many of the most serious human rights issues facing Pakistan, including enforced disappearances, the use of the death penalty, blasphemy laws, the country’s use of military courts, women’s rights including the right to education, and threats to the work of human rights defenders, lawyers and journalists.

According to UN General Assembly Resolution 60/251, “members elected to the Council shall uphold the highest standards in the promotion and protection of human rights.” The Resolution also provides that, “when electing members of the Council, Member States shall take into account the contribution of candidates to the promotion and protection of human rights and their voluntary pledges and commitments made thereto.”

Pakistan’s abuses have been highlighted by various national and international human rights organizations, UN treaty-monitoring bodies, and special procedures of the UN Human Rights Council.

Pakistan has affirmed in its election pledge that it is “firmly resolved to uphold, promote and safeguard universal human rights and fundamental freedoms for all.”

Given the pressing human rights issues in the country, the ICJ, Amnesty International, and Human Rights Watch urge Pakistan to take the necessary action to fulfill these responsibilities.

Achievements and failures of the Human Rights Council session

The ICJ has joined other NGOs in highlighting some of the achievements and failures of the June 2017 session of the UN Human Rights Council in a statement at the end of the session.

The statement, delivered on behalf of the group of NGOs by the International Service for Human Rights (ISHR), read as follows:

At the close of this session, we welcome the commitment by many States from all regions to enhance the Council’s success and effectiveness, and the performance of Human Rights Council (HRC) members through a series of concrete actions. The steps outlined by the Netherlands, such as more competitive HRC elections and the application of objective human rights based criteria to determine whether and how to act on situations of concern, would go a long way in making the Council more accessible, effective, and protective.

The leadership shown by States in the development of joint statements on killings in the Philippines‘ so-called ‘war on drugs’ and threats against human rights defenders, and on the increasingly dire situation in the Maldives are examples of this. We regret the lack of such leadership on other States including China and Egypt.

Although we’d hoped for a more robust response on the Democratic Republic of the Congo (DRC) from the Council, the international team of experts brings hope of uncovering the truth about the horrific violence in the Kasai. The UN, this Council, and the DRC itself must now ensure unhindered access for and support to the team, for it to independently produce a robust and credible report, which will constitute a step towards accountability.

We congratulate Cote d’Ivoire for its six years of cooperation with the UN and the mandate of the Independent Expert. We urge the Council to continue to pay attention to the human rights situation, particularly in the context of recent mutinies, and to assist the country in the implementation of the Independent Expert’s recommendations, including by striving for A-status for its National Human Rights Institution (NHRI).

We also echo the joint call by several States urging you to create a publicly accessible register of alleged acts of intimidation and reprisals and to provide short oral updates on cases at the start of every Item 5 general debate giving States concerned the opportunity to respond.

We also welcome the joint statement of the core group on civil society space together with some NGOs, and its reaffirmation that the “substantive participation of civil society makes this Council’s debates and work, including the UPR, richer and more meaningful”.

Mr President,

We are pleased that both resolutions on discrimination and violence against women were adopted by consensus, and that adverse amendments designed to remove language on comprehensive sexuality education and women human rights defenders were defeated. We regret that the Russian Federation and others systematically seek to remove reference to human rights defenders in all resolutions at each session. Denial of the existence of defenders is absurd, given the long history of formal recognition of the concept by the Commission on Human Rights, Council and General Assembly.

We regret that the resolution on the “protection of the family” fails to fully recognise that older persons are individual rights holders entitled to self-determination and autonomy, and ignores a significant UN process, the General Assembly Open-Ended Working Group on Ageing. The resolution also fails to acknowledge that diverse forms of the family exist. The entire initiative is implicated in an effort to subvert the aims of our human rights system and the universality of rights.

In closing, Mr President, we are dismayed at the lack of progress in terms of ensuring the most effective participation of civil society, in accordance with established rules and practice of the Council. Although symbolic, the massive reduction of reserved NGO desk space in this room is illustrative of this.

We are concerned about the lack of formal engagement by you and your Bureau with civil society, the absence of visible steps to curb and respond to intimidation or reprisals, and the abusive interruptions of NGO statements, including in some instances by the chair. And we look forward to engaging with your office to reverse this trend.

Ensuring women’s access to justice for gender based violence (statements to UN)

During a panel discussion at the UN Human Rights Council, the ICJ delivered an oral statement on the role of men and boys in eliminating violence against women by ensuring women’s access to justice for gender based violence.

The statement was delivered during the first panel of the Council’s annual full-day discussion on the human rights of women. The panel focused on accelerating efforts to eliminate violence against women by engaging men and boys in preventing and responding to violence against women.

The ICJ’s statement was as follows:

Violence against women is a widespread human rights abuse rooted in patriarchal societies and gender stereotypes that are harmful to everyone. As the panel have recognised, the international community cannot address the issue as though it is only a problem for women and we welcome the positive focus on the role of men and boys as beneficiaries and agents of change.

The ICJ remains concerned about women’s access to justice for gender based violence. Strong domestic laws, grounded in an international human rights framework, that are upheld by a robust and independent judiciary, are essential components of tackling the problem.

However, the ICJ has worked with lawyers, judges and civil society to assess the obstacles that continue to face women seeking justice for gender based violence and we know that laws alone are not enough. It must also be acknowledged that many laws are based on patriarchal norms and stereotypes that are intrinsically discriminatory against women seeking justice through the legal system.

Behavioural change is required in not only preventing violence against women but also in ensuring that justice is available to those that have been subject to this violence. Men have a pivotal role to play in working with women to ensure that a gender based perspective is applied to the way laws are accessed and implemented.

We applaud the panellists’ focus on engaging with men and boys to prevent harmful behaviours of violence against women from taking root.

However, we would like to ask what role panellists suggest men and boys have in:

a) ensuring that perpetrators are held accountable for their actions, and

b) in supporting the justice system in rehabilitating offenders to prevent further acts of violence, without compromising justice and services available to women?

In response to the ICJ’s statement the Special Rapporteur on Violence Against Women commented that structural problems impact on the effectiveness of laws.

Mr Abhijit Das noted that prosecution was only one means of addressing gender inequality and that engagement with men and boys needed to go beyond this to include the widest number of stakeholders possible, including those men and boys that do not perpetrate violence against women.

Mr Anthony Keedi noted that rehabilitation was a key component of addressing violence against women and must be at the heart of change to prevent cycles of violence from continuing.
